HOUSE BILL No. 1354 A BILL FOR AN ACT to amend the Indiana Code concerning professions and occupations. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 25-0.5-1-23, AS ADDED BY P.L.3-2014, 2 SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 3 JULY 1, 2025]: Sec. 23. IC 25-1-1.1-4 applies to an individual: 4 (1) licensed; or 5 (2) certified; 6 (3) registered; or 7 (4) permitted; 8 under IC 25-38.1 (veterinarians and veterinary technicians). 9 SECTION 2. IC 25-1-1.1-4, AS AMENDED BY P.L.15-2024, 10 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 11 JULY 1, 2025]: Sec. 4. (a) This section applies to an individual who is 12 applying for, or will be applying for an initial: 13 (1) license; or an initial 14 (2) certificate; 15 (3) registration; or 16 (4) permit; 17 under one (1) of the occupations or professions described in HB 1354—LS 7205/DI 148 2 1 IC 25-0.5-1. 2 (b) As used in this chapter, "national criminal history background 3 check" means the criminal history record system maintained by the 4 Federal Bureau of Investigation based on fingerprint identification or 5 any other method of positive identification. 6 (c) An individual applying for an initial: 7 (1) license; or initial 8 (2) certificate; 9 (3) registration; or 10 (4) permit; 11 specified in subsection (a) shall submit to a state and national criminal 12 history background check at the cost of the individual. 13 (d) The state police department shall release the results of a national 14 criminal history background check conducted under this section: to: 15 (1) to the Indiana professional licensing agency; or 16 (2) for a license or certificate issued under IC 25-38.1, to the 17 following: 18 (A) The chief administrative officer of the board of veterinary 19 medicine. 20 (B) An authorized agent of the chief administrative officer 21 described in clause (A). 22 (B) An employee of the board of animal health authorized 23 to perform activities to carry out the purpose of the board 24 of veterinary medicine under IC 15-17.5-3-2. 25 (e) A board, a commission, or a committee may conduct a random 26 audit and require an individual seeking a renewal of a license or a 27 certificate specified in subsection (a) to submit to a national criminal 28 history background check at the cost of the individual.
