HOUSE BILL No. 1376 A BILL FOR AN ACT to amend the Indiana Code concerning education. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 20-34-4.5-0.2, AS ADDED BY P.L.117-2017, 2 SECTION 3, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 3 JULY 1, 2025]: Sec. 0.2. As used in this chapter, "emergency 4 medication" means any of the following: 5 (1) Albuterol. 6 (2) Epinephrine. 7 (3) Naloxone, A federal Food and Drug Administration 8 approved opioid overdose reversal medication, including 9 nasal spray, as an overdose intervention drug that is subject to 10 IC 16-42-27. 11 SECTION 2. IC 20-34-4.5-1, AS AMENDED BY P.L.164-2023, 12 SECTION 55, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 13 JULY 1, 2025]: Sec. 1. (a) Except as provided in subsection (c), a 14 school or a school corporation may: 15 (1) fill a prescription or statewide standing order for an 16 emergency medication; and 17 (2) store the emergency medication: 2025 IN 1376—LS 6194/DI 152 2 1 (A) if the prescription or statewide standing order is filled by 2 a school, in the school; or 3 (B) if the prescription or statewide standing order is filled by 4 a school corporation, in a school in the school corporation; 5 and 6 (3) work in cooperation with an opioid overdose prevention 7 organization to carry out the purposes of this chapter; 8 if a health care provider who is licensed in Indiana and whose scope of 9 practice includes the prescribing of medication writes the prescription 10 or the state health commissioner issues a statewide standing order for 11 the emergency medication for the school or school corporation. 12 (b) The school shall store the emergency medication in a safe 13 location in which only school employees have access. 14 (c) A school or a school corporation shall: 15 (1) fill a statewide standing order or prescription for a federal 16 Food and Drug Administration approved opioid overdose 17 reversal medication, including nasal spray; and 18 (2) store the medication described in subdivision (1) in a 19 location in the school that is readily accessible for use by a 20 school nurse or by a school employee who has received 21 training described in section 2 of this chapter. 22 SECTION 3. IC 20-34-4.5-3, AS AMENDED BY P.L.164-2023, 23 SECTION 56, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 24 JULY 1, 2025]: Sec. 3. (a) A health care provider who is licensed in 25 Indiana and whose scope of practice includes the prescribing of 26 medication may: 27 (1) write; or 28 (2) transmit in an electronic format for an electronically 29 transmitted prescription; 30 a prescription, drug order, or protocol for an emergency medication for 31 a school or school corporation. 32 (b) Except as provided in subsection (d), the state health 33 commissioner or the state health commissioner's designee who is a 34 licensed prescriber may issue a statewide standing order, prescription, 35 or protocol for emergency stock medication for schools or school 36 corporations. 37 (c) Except as provided in subsection (e), a pharmacist licensed 38 under IC 25-26 may dispense a valid prescription, drug order, standing 39 order, or protocol for an emergency medication issued in the name of 40 a school or school corporation. 41 (d) The state health commissioner or the state health 42 commissioner's designee who is a licensed prescriber shall issue a 2025 IN 1376—LS 6194/DI 152 3 1 statewide standing order, prescription, or protocol for a federal 2 Food and Drug Administration approved opioid overdose reversal 3 medication, including nasal spray, for each: 4 (1) school; or 5 (2) school corporation on behalf of each school. 6 The standing order, prescription, or protocol shall provide at least 7 two (2) individual doses of a federal Food and Drug Administration 8 approved opioid overdose reversal medication per five hundred 9 (500) students enrolled at a school. 10 (e) A pharmacist licensed under IC 25-26 shall dispense a valid 11 prescription, drug order, standing order, or protocol for a federal 12 Food and Drug Administration approved opioid overdose reversal 13 medication issued in the name of a school or a school corporation 14 on behalf of each school. 2025 IN 1376—LS 6194/DI 152
