Summary of Legislation: This bill establishes the rape kit backlog fund to provide funding for assisting law
enforcement agencies and testing labs in eliminating the backlog of untested rape kits. It requires the State
Police Department to provide grants to law enforcement agencies and testing labs to help eliminate the
backlog of untested rape kits. It requires the Criminal Justice Institute to make an annual report to the General
Assembly. It also provides that before January 1, 2027, every law enforcement agency and testing lab shall
process certain rape kits in their possession that are not completely processed as of July 1, 2025. 
This bill also makes an appropriation.
Effective Date:  July 1, 2025.
Explanation of State Expenditures: Rape Kit Backlog Fund: The bill makes an appropriation of $2.5 M
for each fiscal year starting in FY 2026 for the Rape Kit Backlog Fund. Money in the fund does not revert
to the General Fund at the end of the fiscal year. The fund will be administered through Indiana State Police
(ISP). The ISP will create a grant process for local law enforcement and testing labs to apply for and receive
grants. The ISP can implement this program within existing resources. 
Reporting: The bill would increase the workload of the Criminal Justice Institute (CJI) to send a report to
the General Assembly before November 1 of each year on the status of the backlog of untested rape kits in
Indiana and how funds were directed for the prior calendar year and notify each law enforcement agency of
the requirements of the bill by September 1, 2025. The bill’s requirements are within the agency’s routine
administrative functions and should be able to be implemented with no additional appropriations, assuming
near customary agency staffing and resource levels.   
Explanation of State Revenues: 
Explanation of Local Expenditures: The bill would increase workload and expenditures for law
enforcement agencies to process each unprocessed rape kit in its possession as of July 1, 2025, before
January 1, 2027. Workload and expenditures could be offset from grant revenue received from the Rape Kit
HB 1413	1 Backlog Fund.   
Explanation of Local Revenues: The bill could increase revenue to local law enforcement agencies to the
extent that they apply for grants. The revenue received from the grants is restricted for use to help eliminate
the backlog of untested rape kits.
