Synopsis:  Lab grown meat labeling. Requires the department of
agriculture, board of animal health, and the Indiana department of
health to conduct a study to determine the safety of cultivated meat
products for human consumption. Establishes a one year moratorium
on the sale of cultivated meat products in Indiana. Prohibits a person
from intentionally misbranding a cultivated meat product as a meat
product. Provides that the cultivated meat product is misbranded as a
meat product if the cultivated meat product is: (1) advertised; (2)
labeled; or (3) offered for sale or sold; in a manner that does not clearly
indicate that it is a cultivated meat product or not in accordance with
rules adopted by the board of animal health (BOAH). Requires BOAH
to administer the chapter.

HOUSE BILL No. 1425
A BILL FOR AN ACT to amend the Indiana Code concerning
agriculture and animals.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 15-17-2-22.5 IS ADDED TO THE INDIANA
2 CODE AS A NEW SECTION TO READ AS FOLLOWS
3 [EFFECTIVE JULY 1, 2025]: Sec. 22.5. "Cultivated meat product"
4 means animal protein grown in a facility from extracted animal
5 stem cells and arranged in a similar structure as animal tissues to
6 replicate the sensory and nutritional profiles of meat products.
7 SECTION 2. IC 15-17-2-54, AS ADDED BY P.L.2-2008,
8 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
9 JULY 1, 2025]: Sec. 54. (a) "Meat food product" and "meat product"
10 means a product capable of use as human food that is made wholly or
11 in part from meat or other part of the carcass of:
12 (1) cattle;
13 (2) sheep;
14 (3) swine;
15 (4) equines;
16 (5) bison;
17 (6) farm raised cervidae;

1 (7) ratitae; or
2 (8) goats.
3 (b) The term does not include products that:
4 (1) contain meat or other parts of such carcasses only in a
5 relatively small proportion; or
6 (2) historically have not been considered by consumers as
7 products of the meat food industry and that are exempted from
8 definition as a meat food product by the state veterinarian under
9 conditions the state veterinarian prescribes to ensure that the meat
10 or other parts of the carcass contained in the product are not
11 adulterated and that the products are not represented as meat food
12 products.
13 (c) The term does not include an alternative meat product.
14 SECTION 3. IC 15-17-2-83, AS ADDED BY P.L.2-2008,
15 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
16 JULY 1, 2025]: Sec. 83. (a) "Person" means any individual, trustee,
17 receiver, corporation, limited liability company, partnership, and any
18 other firm, organization, association, cooperative, or group of
19 individuals or persons.
20 (b) "Person", for purposes of IC 15-17-5-6.1 and IC 15-17-5-6.5,
21 means any individual, trustee, receiver, corporation, limited
22 liability company, partnership, official establishment (as defined
23 in section 72 of this chapter), and any other firm, organization,
24 association, cooperative, or group of individuals or persons.
25 SECTION 4. IC 15-17-2-103 IS ADDED TO THE INDIANA
26 CODE AS A NEW SECTION TO READ AS FOLLOWS
27 [EFFECTIVE JULY 1, 2026]: Sec. 103. "Wholesaler", for purposes
28 of IC 15-17-5-6.5, means any person that sells or distributes meat
29 products or cultivated meat products to another person for the
30 purpose of resale.
31 SECTION 5. IC 15-17-5-6.1 IS ADDED TO THE INDIANA CODE
32 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
33 1, 2025]: Sec. 6.1. (a) A person shall not:
34 (1) sell;
35 (2) offer for sale; or
36 (3) manufacture;
37 a cultivated meat product in Indiana during the period beginning
38 July 1, 2025, and ending June 30, 2026.
39 (b) The board may:
40 (1) take any enforcement action authorized under this chapter
41 for violations of this section; or
42 (2) impose a civil penalty of not more than ten thousand

1 dollars ($10,000) on a person that violates this section.
2 Civil penalties collected under this section shall be deposited in the
3 state general fund.
4 (c) Each day a violation continues constitutes a separate offense.
5 (d) After notice and hearing in compliance with IC 4-21.5, the
6 board may seek a court order to enjoin a person from selling,
7 offering for sale, or manufacturing cultivated meat products if the
8 person repeatedly and persistently fails to comply with this section.
9 (e) This section expires July 1, 2027.
10 SECTION 6. IC 15-17-5-6.3 IS ADDED TO THE INDIANA CODE
11 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
12 1, 2025]: Sec. 6.3. (a) The:
13 (1) Indiana state department of agriculture;
14 (2) board; and
15 (3) Indiana department of health;
16 shall jointly conduct a study that determines the safety of
17 cultivated meat products for human consumption.
18 (b) The:
19 (1) Indiana state department of agriculture;
20 (2) board; and
21 (3) Indiana department of health;
22 shall issue a report to the legislative council containing the findings
23 and recommendations from the study under subsection (a),
24 including any recommended legislation, in an electronic format
25 under IC 5-14-6 not later than December 1, 2025.
26 (c) The:
27 (1) Indiana state department of agriculture;
28 (2) board; and
29 (3) Indiana department of health;
30 may not contract with an entity or organization to conduct the
31 study described in subsection (a). The costs to conduct the study
32 described in subsection (a) are payable solely from appropriations
33 available to each entity listed in subdivisions (1) through (3).
34 (d) This section expires December 1, 2026.
35 SECTION 7. IC 15-17-5-6.5 IS ADDED TO THE INDIANA CODE
36 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
37 1, 2026]: Sec. 6.5. (a) A person that labels meat products shall not
38 misbrand a cultivated meat product.
39 (b) A cultivated meat product is misbranded if the cultivated
40 meat product is:
41 (1) advertised;
42 (2) labeled; or

1 (3) offered for sale or sold;
2 in a manner that does not clearly indicate that it is a cultivated
3 meat product or not in accordance with rules adopted by the
4 board.
5 (c) The board shall investigate complaints that a person:
6 (1) offered for sale; or
7 (2) sold;
8 a misbranded cultivated meat product.
9 (d) A person shall include the phrase "THIS IS AN
10 IMITATION MEAT PRODUCT" on the package containing a
11 cultivated meat product.
12 (e) The board shall adopt rules under IC 4-22-2 to carry out its
13 responsibilities under this section.
