It provides notice and reconsideration procedures. It provides requirements for prosecuting attorneys and law enforcement officers. It also provides civil immunity to prosecuting attorneys for acts related to a Giglio list. Effective Date: July 1, 2025. Explanation of State Expenditures: Explanation of State Revenues: Court Fee Revenue: If fewer civil cases occur and court fees are collected, revenue to the state General Fund will decrease. Explanation of Local Expenditures: Giglio List Procedure: Prosecuting attorneys would have an increase in workload for procedures regarding the Giglio List. The bill’s requirements are within the agency’s routine administrative functions and should be able to be implemented with no additional appropriations, assuming near customary agency staffing and resource levels. Giglio Designee: Local law enforcement agencies may have an increase workload to designate a person in the law enforcement agency as a Giglio designee and handle the associated workload of Giglio issues. The bill’s requirements are within the agency’s routine administrative functions and should be able to be implemented with no additional appropriations, assuming near customary agency staffing and resource levels. Immunity: Prosecuting attorneys have immunity from civil liability for placing a law enforcement officer on the Giglio list. This provision could reduce local expenditures by reducing court costs from fewer civil cases filed.
