ENGROSSED HOUSE BILL No. 1634 A BILL FOR AN ACT to amend the Indiana Code concerning education. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 20-28-3-1, AS AMENDED BY P.L.150-2024, 2 SECTION 21, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 3 JULY 1, 2025]: Sec. 1. (a) As used in this section, "teacher candidate" 4 means an individual recommended for an initial teaching license from 5 a teacher preparation program located in Indiana. 6 (b) As used in this section, "teacher preparation program" includes, 7 but is not limited to, the following: 8 (1) A teacher education school or department. 9 (2) A transition to teaching program under IC 20-28-4. 10 (3) Any other entity approved by the department to offer a course 11 of study leading to an initial teaching license. 12 (c) The department shall: 13 (1) arrange a statewide system of professional instruction for 14 teacher education; 15 (2) accredit and review teacher preparation programs that comply 16 with the rules of the department; 17 (3) approve content area licensure programs for particular kinds EH 1634—LS 7434/DI 110 2 1 of teachers in accredited teacher preparation programs; and 2 (4) specify the types of licenses for individuals who complete 3 programs of approved courses. 4 (d) The department shall work with teacher preparation programs to 5 develop a system of teacher education that ensures individuals who 6 complete teacher preparation programs are able to meet the highest 7 professional standards. 8 (e) Before July 1, 2015, the department shall establish standards for 9 the continuous improvement of program processes and the performance 10 of individuals who complete teacher preparation programs. The state 11 board shall adopt rules containing the standards not later than two 12 hundred seventy (270) days after the department finishes the standards. 13 (f) The standards established under subsection (e) must include 14 benchmarks for performance, including test score data for each teacher 15 preparation entity on content area licensure tests and test score data for 16 each teacher preparation entity on pedagogy licensure tests. 17 (g) Each teacher preparation program shall annually report the 18 program's performance on the standards and benchmarks established 19 under this section to the department. The department shall make the 20 information reported under this subsection available to the public on 21 the department's website. Each teacher preparation program shall make 22 the information reported under this subsection available to the public 23 on the teacher preparation program's website. In addition to reporting 24 performance, each teacher preparation program must report to the 25 department the following: 26 (1) The attrition, retention, and completion rates of teacher 27 candidates for the previous three (3) calendar years. The teacher 28 preparation program must also provide underlying data, as 29 determined by the department, used as part of calculating the 30 teacher preparation program's retention rates. 31 (2) The number of teacher candidates in each content area who 32 complete the teacher preparation program during the year, 33 disaggregated by ranges of cumulative grade point averages. 34 (3) The number of teacher candidates in each content area who, 35 during the year: 36 (A) do not pass a content area licensure examination; and 37 (B) do not retake the content area licensure examination. 38 (h) In making information available to the public on the 39 department's website, the department shall include in the report under 40 subsection (g), in addition to the matrix ratings described in subsection 41 (i), the following information: 42 (1) Average scaled or standard scores of teacher candidates who EH 1634—LS 7434/DI 110 3 1 complete teacher preparation programs on basic skills, content 2 area, and pedagogy licensure examinations. 3 (2) The average number of times teacher candidates who 4 complete a teacher preparation program take each licensing test 5 before receiving a passing score and the percentage of teacher 6 candidates who receive a passing score on each licensing test on 7 the teacher candidates' first attempts. 8 (i) Not later than July 30, 2016, the department and the commission 9 for higher education, in conjunction with the state board, the 10 Independent Colleges of Indiana, Inc., and teacher preparation 11 programs, shall establish a matrix rating system for teacher preparation 12 programs based on the performance of the programs as demonstrated 13 by the data collected under subsections (g) and (h). The matrix rating 14 system may not rank or compare teacher preparation programs. The 15 matrix rating system must be based on data collected for teachers who 16 initially receive their teaching license during the previous three (3) 17 years. The department shall make the matrix ratings available to the 18 public on the department's website. 19 (j) Each teacher preparation program shall report to the department, 20 in a manner prescribed by the department, the teacher preparation 21 program's admission practices, in accordance with: 22 (1) the Council for the Accreditation of Educator Preparation 23 standards, for teacher preparation programs accredited by the 24 Council for the Accreditation of Educator Preparation; 25 (2) rigorous academic entry requirements for admission into a 26 teacher preparatory program that are equivalent to the minimum 27 academic requirements determined by the Council for the 28 Accreditation of Educator Preparation, for teacher preparation 29 programs that are not accredited by the Council for the 30 Accreditation of Educator Preparation; or 31 (3) the Association for Advancing Quality in Educator 32 Preparation standards, for teacher preparation programs 33 accredited by the Association for Advancing Quality in Educator 34 Preparation. 35 The department shall include information reported to the department 36 on the department's website. 37 (k) Not later than July 30, 2016, the department and the commission 38 for higher education, in conjunction with the state board, the 39 Independent Colleges of Indiana, Inc., and teacher preparation 40 programs, shall establish a minimum rating under the matrix rating 41 system established under subsection (i) that teacher preparation 42 programs must achieve to avoid referral under subsection (l). EH 1634—LS 7434/DI 110 4 1 (l) Not later than July 1 of each year, the department shall submit a 2 list of teacher preparation programs that do not meet the minimum 3 rating established under subsection (k) or the requirements of section 4 3.1 or 3.2 of this chapter to the commission for higher education and 5 the Independent Colleges of Indiana, Inc. for one (1) of the following 6 actions: 7 (1) In the case of a state educational institution, the commission 8 for higher education shall place the teacher preparation program 9 on an improvement plan with clear performance goals and a 10 designated period in which the performance goals must be 11 achieved. 12 (2) In the case of a proprietary postsecondary educational 13 institution, the commission for higher education shall recommend 14 to the teacher preparation program an improvement plan with 15 clear performance goals and a designated period in which the 16 performance goals should be achieved. 17 (3) In the case of a nonprofit college or university, the 18 Independent Colleges of Indiana, Inc., shall coordinate a peer 19 review process to make recommendations to the peer institution 20 in achieving the department's performance metrics. 21 (m) The department shall approve at least two (2) accreditors that: 22 (1) accredit teacher preparation programs; and 23 (2) are recognized by the Council for Higher Education 24 Accreditation; 25 to accredit teacher preparation programs for use in Indiana. 26 (n) Not later than December 31, 2024, the department and the 27 commission for higher education, in conjunction with the state board, 28 shall partner with teacher preparation programs to receive an outside 29 evaluation by a nationally recognized nonprofit, nonpartisan 30 organization that leverages evidence based approaches on the science 31 of reading to evaluate teacher preparation reading instruction programs. 32 SECTION 2. IC 20-28-3-3.2, AS ADDED BY P.L.150-2024, 33 SECTION 22, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 34 JULY 1, 2025]: Sec. 3.2. (a) As used in this section, "teacher 35 candidate" has the meaning set forth in section 3.1(a) of this chapter. 36 (b) As used in this section, "teacher preparation program" includes 37 the following: 38 (1) A teacher education school or department. 39 (2) A transition to teaching program under IC 20-28-4. 40 (3) Any other entity approved by the department to offer a course 41 of study leading to an initial teaching license. 42 (c) The department shall develop guidelines for accredited teacher EH 1634—LS 7434/DI 110 5 1 preparation programs regarding the use of curriculum or content that 2 prepares elementary school teacher candidates to: 3 (1) effectively teach foundational math skills explicitly and 4 systematically; aligned with evidence based instructional 5 strategies to promote: 6 (A) conceptual understanding; 7 (B) procedural fluency; and 8 (C) real world problem solving; 9 (2) implement math instruction using high quality instructional 10 material; and 11 (3) understand and use student data to make instructional 12 decisions. 13 (d) The department shall conduct a review of accredited teacher 14 preparation programs for alignment with the requirements of 15 subsection (c) on a schedule determined by the department. 16 (e) Upon review by the department under subsection (d), an 17 accredited teacher preparation program that is not in alignment 18 with the requirements of subsection (c) shall be submitted for a 19 referral under section 1(l) of this chapter. 20 (f) If an accredited teacher preparation program: 21 (1) has been submitted for a referral under subsection (e); and 22 (2) fails to meet the criteria of the improvement plan 23 developed under section 1(l) of this chapter; 24 the department shall revoke the teacher preparation program's 25 right to use the word "accredited". 26 SECTION 3. IC 20-30-18 IS ADDED TO THE INDIANA CODE 27 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE 28 JULY 1, 2025]: 29 Chapter 18. Middle School Advanced Math Course 30 Requirements 31 Sec. 1. As used in this chapter, "charter middle school" means 32 a charter school that is a middle school. 33 Sec. 2. As used in this chapter, "middle school" means any 34 school of a school corporation or charter school that provides 35 instruction to students in any combination of grades 6, 7, or 8. 36 Sec. 3. (a) Each school corporation and charter middle school 37 shall automatically enroll in a middle school advanced math course 38 a student who: 39 (1) scores "above proficient" on the ILEARN assessment for 40 math in grade 5, 6, or 7; and 41 (2) earns a "C" or higher in the student's math course work. 42 (b) A parent of a student described in subsection (a) may opt the EH 1634—LS 7434/DI 110 6 1 student out of automatic enrollment under subsection (a). 2 (c) If a student is automatically enrolled in a middle school 3 advanced math course under this section, the school corporation or 4 charter school in which the student is enrolled shall provide notice 5 to a parent of the student that the: 6 (1) student has been automatically enrolled; and 7 (2) parent may provide notice to the school to opt the student 8 out of the automatic enrollment. 9 Sec. 4. Not later than July 1, 2026, and not later than July 1 each 10 year thereafter, the department shall do the following: 11 (1) Prepare a report that includes the following information: 12 (A) The percentage of students, disaggregated by grade 13 and school, who: 14 (i) scored "above proficient" on the ILEARN assessment 15 for math in grades 5, 6, and 7; and 16 (ii) were enrolled in an advanced math course in the 17 subsequent school year. 18 (B) The percentage of students, disaggregated by grade 19 and school, who: 20 (i) scored "above proficient" on the ILEARN assessment 21 for math in grades 5, 6, and 7; and 22 (ii) were not enrolled in an advanced math course in the 23 subsequent school year. 24 (2) Submit the report to the legislative council in an electronic 25 format under IC 5-14-6. 26 SECTION 4. IC 20-32-6.5 IS ADDED TO THE INDIANA CODE 27 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 28 1, 2025]: 29 Chapter 6.5. Mathematics Screening, Evaluations, and 30 Interventions 31 Sec. 1. As used in this chapter, "school" means any of the 32 following: 33 (1) A public school, including a charter school. 34 (2) A state accredited nonpublic school. 35 (3) An eligible school (as defined in IC 20-51-1-4.7). 36 Sec. 2. (a) Beginning with the 2026-2027 school year, each school 37 shall administer to all students of the school in kindergarten, grade 38 1, and grade 2 screeners approved by the department to identify 39 students at risk of not meeting grade level proficiency. 40 (b) The screeners must: 41 (1) align to Indiana academic standards for mathematics; 42 (2) measure foundational numeracy and computation skills; EH 1634—LS 7434/DI 110 7 1 (3) receive a convincing or partially convincing rating for 2 accuracy, reliability, and validity by: 3 (A) the National Center on Intensive Intervention; or 4 (B) another third party approved by the department; 5 (4) provide parents and schools with data analysis guides for 6 interpreting results and comprehensive support for schools to 7 guide classroom instruction and the implementation of 8 mathematics interventions; and 9 (5) provide the department with an annual analysis of 10 statewide data trends to support identification of deficiencies 11 in mathematics and guide targeted intervention efforts. 12 Sec. 3. (a) Beginning with the 2026-2027 school year, if a school 13 determines that a student in kindergarten through grade 8 is at 14 risk of not achieving grade level proficiency in mathematics as 15 determined by an analysis of the student's data from: 16 (1) a grade level screener approved by the department; or 17 (2) a through-year statewide assessment; 18 the school must provide intervention that meets the requirements 19 under subsection (b). 20 (b) A school shall provide intervention to a student described in 21 subsection (a) that meets the following conditions: 22 (1) The intervention includes a multitiered system of support 23 that progresses from less to more intensive support based on 24 the student's individual needs. 25 (2) The intervention is aligned to daily Tier I instruction and 26 standard level learning progressions. 27 (3) The intervention is: 28 (A) targeted; 29 (B) differentiated; and 30 (C) supplemental to Tier I instruction. 31 (4) The intervention: 32 (A) is aligned with evidence based instructional strategies 33 to promote conceptual understanding, procedural fluency, 34 and real world problem solving; and 35 (B) allows a student opportunities to interact, show 36 progress, and demonstrate understanding through 37 rigorous grade level content. 38 (5) The intervention includes continual assessment and in 39 depth analysis of each student's data to inform the flexible 40 movement in and out of Tiers II and III. 41 (c) The department shall provide guidance on the multitiered 42 system that a school is required to provide under subsection (b).
