Crider BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED: GENERAL IMPACT: Local DEDICATED FEDERAL Summary of Legislation: This bill specifies, for purposes of the expungement statute, that a person whose conviction for a serious violent felony involving the possession or use of a firearm is expunged is entitled to restoration of the person's right to possess a firearm only if the court finds, following a hearing, that restoration of the person's right to possess a firearm is unlikely to present a danger to the public. Effective Date: July 1, 2025. Explanation of State Expenditures: Explanation of State Revenues: Explanation of Local Expenditures: The courts should be able to accommodate additional hearings, if necessary, with existing resources. The following summarizes the number of expungement cases that were disposed in CY 2023 by courts with criminal jurisdiction in Indiana: • Marion County disposed of an average of almost 60 expungements per week; • Ten counties averaged between 5 and 15 per week; • Twenty-four counties averaged between 1 and 5 per week; • The remaining 57 counties averaged less than 1 per week.
