DeVon FUNDS AFFECTED:XGENERAL IMPACT: State DEDICATED FEDERAL Summary of Legislation: This bill specifies that the Adult Protective Services reporting applies to reports received through a statewide toll free telephone call or through online reporting. It requires an Adult Protective Services Unit to investigate and determine whether a report is to be referred to law enforcement or another agency for investigation. It removes language specifying entities to be informed of an endangered adult report. This bill removes language requiring the Prosecuting Attorneys Council of Indiana to concur on standards of practice concerning services provided by the unit. This bill removes language that required the Division of Aging to maintain nonidentifying statistical records concerning unsubstantiated reports about endangered adults. It authorizes the Division to determine when endangered adult reports may be made available and only requires the alleged victim to give consent of the release. (Current law requires all parties to give consent.) This bill requires the unit to share appropriate information to coordinate and implement services. It also removes language that allowed a prosecuting attorney or head of a governmental entity to give written permission for a unit or staff member to be designated as a representative. Effective Date: July 1, 2025. Explanation of State Expenditures: Summary: The bill’s requirements regarding the notification of complaints, concurrences on the standards of practice, maintenance of records, and sharing of reports is likely to decrease workload for the Division of Aging. Workload may also decrease for the Prosecuting Attorneys Council of Indiana as they will no longer be required to concur on the standards of practice of APS unit services. The bill modifies the definition of an endangered adult to remove “habitual drunkenness” and “excessive use of drugs” as qualifiers. This is expected to result in fewer investigated endangered adult complaints. SB 182 1 Additional Information: In CY 2023, APS units received 20,990 service calls which resulted in 11,635 cases. The remaining reports were resolved over the phone or were referred to other agencies for service. During CY 2023, there were 1,903 substantiated claims made for neglect or self-neglect. Claims resulting from habitual drunkenness or excessive use of drugs are included within these claims.
