Synopsis:  Address registry for unlawful aliens. Requires an unlawful
alien to register with the local law enforcement authority in the alien's
county of residence. Makes failure to register a Class A misdemeanor,
and increases the penalty to a Level 6 felony for a second or subsequent
offense.

A BILL FOR AN ACT to amend the Indiana Code concerning state
and local administration.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 9-14-15 IS ADDED TO THE INDIANA CODE AS
2 A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2025]:
4 Chapter 15. Illegal Alien Address Registration
5 Sec. 1. As used in this chapter, "alien" has the meaning set forth
6 in IC 35-44.1-5-2.
7 Sec. 2. As used in this chapter, "unlawfully present" means that
8 the alien has come to, entered, or remained in the United States in
9 violation of law.
10 Sec. 3. Beginning January 1, 2026, an alien who is unlawfully
11 present in the United States and who resides in Indiana shall
12 register the alien's name and address with the bureau. If the alien's
13 name or address changes, the alien shall report the change to the
14 bureau not later than ten (10) days after the change.
15 Sec. 4. An alien who knowingly or intentionally fails to comply
16 with section 3 of this chapter commits failing to register as an
17 unlawful alien, a Class A misdemeanor. However, the offense is a

1 Level 6 felony if the alien has a prior unrelated conviction for a
2 violation of this chapter.
3 Sec. 5. A determination by the United States Department of
4 Homeland Security that an alien has come to, entered, or remained
5 in the United States in violation of law is evidence that the alien is
6 in the United States in violation of law.
7 Sec. 6. Before January 1, 2026, the bureau shall establish a
8 registration system that complies with this chapter. This section
9 expires December 31, 2026.
10 SECTION 2. IC 35-52-9.1-1.5 IS ADDED TO THE INDIANA
11 CODE AS A NEW SECTION TO READ AS FOLLOWS
12 [EFFECTIVE JULY 1, 2025]: Sec. 1.5. IC 9-14-15-4 defines a crime
13 concerning aliens.
