SENATE BILL No. 350 A BILL FOR AN ACT to amend the Indiana Code concerning education. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 16-46-10-3, AS AMENDED BY P.L.164-2023, 2 SECTION 47, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 3 JULY 1, 2025]: Sec. 3. (a) Funding provided a local board of health 4 under section 2.2 or 2.3 of this chapter may be used by the local board 5 to provide any of the following services: 6 (1) Core public health services. 7 (2) Any statutorily required actions for a local health department. 8 (3) Evidence based programs to prevent or reduce the prevalence 9 of health issues or improve the health and behavioral health of 10 Indiana residents as outlined in the plan described in 11 IC 16-30-3-2. 12 (4) Providing automated external defibrillators (AEDs) to 13 school corporations, charter schools, and state accredited 14 nonpublic schools pursuant to each school corporation's, 15 charter school's, and state accredited nonpublic school's 16 venue specific emergency action plan for sudden cardiac 17 arrest (as defined in IC 20-34-8-3.5) developed by a local 2025 IN 350—LS 7350/DI 152 2 1 health department under IC 20-34-8-4.5. 2 (b) Money granted a local board of health from the local public 3 health fund may not be used for any purpose other than for the services 4 listed in this section. 5 (c) A county may not use more than ten percent (10%) of the funds 6 received under section 2.2 or 2.3 of this chapter during a fiscal year for 7 capital expenditures, including: 8 (1) the purchase, construction, or renovation of buildings or other 9 structures; 10 (2) land acquisition; and 11 (3) the purchase of vehicles and other transportation equipment. 12 (d) Funds used for capital expenditures under subsection (c) must 13 be included on the annual financial report required under section 2.2(f) 14 or 2.3(c) of this chapter and posted on the local health department's 15 website. 16 (e) Before funds may be used to hire or contract for the provision or 17 administration of core public health services, the local health 18 department shall post the position or contract to the public for at least 19 thirty (30) days. 20 SECTION 2. IC 20-34-8-3.5, AS ADDED BY P.L.187-2023, 21 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 22 JULY 1, 2025]: Sec. 3.5. As used in this chapter, "venue specific 23 emergency action plan for sudden cardiac arrest" means a plan 24 developed used by a school corporation, charter school, or state 25 accredited nonpublic school that 26 (1) includes detailed written instructions regarding how to 27 respond to sudden cardiac arrest; and 28 (2) indicates the location of the nearest automated external 29 defibrillator (AED) at the venue. 30 establishing steps to reduce death from cardiac arrest in any 31 setting. 32 SECTION 3. IC 20-34-8-4.5 IS ADDED TO THE INDIANA CODE 33 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 34 1, 2025]: Sec. 4.5. (a) For the 2025-2026 school year, a local health 35 department (established under IC 16-20) located within a district 36 in which a school corporation, charter school, or state accredited 37 nonpublic school is located shall do the following: 38 (1) Develop a venue specific emergency action plan for sudden 39 cardiac arrest in collaboration with the school corporation, 40 charter school, or state accredited nonpublic school. 41 (2) Provide ongoing support to the school corporation, charter 42 school, or state accredited nonpublic school for the venue 2025 IN 350—LS 7350/DI 152 3 1 specific emergency action plan for sudden cardiac arrest 2 described in subdivision (1), if support is requested by the 3 school. 4 (b) A venue specific emergency action plan for sudden cardiac 5 arrest developed under this section must include the following: 6 (1) A cardiac emergency response plan (CERP) that includes 7 the core elements set forth by either the American Heart 8 Association or other nationally recognized recommendations, 9 including recommendations set by the National Athletic 10 Trainers Association. 11 (2) A requirement that the CERP be widely distributed and 12 posted throughout the school, rehearsed frequently, and 13 updated annually. 14 (3) A requirement that automated external defibrillators 15 (AEDs) must be clearly marked and easily accessible at each 16 venue where an athletic activity may occur, or within one (1) 17 to three (3) minutes of where each athletic activity is held. 18 AEDs must be placed in accordance with guidelines set by the 19 American Heart Association, or other nationally recognized 20 guidelines focused on emergency cardiovascular care. 21 (4) A requirement that the governing authority of a school 22 corporation or the equivalent authority of a charter school or 23 state accredited nonpublic school work directly with local 24 providers of emergency medical services (as defined in 25 IC 16-18-2-110) to integrate the CERP into the community's 26 local provider protocols. 27 (5) A requirement that AEDs must be made available for use 28 by all individuals, regardless of an individual's training. 29 (6) A requirement that appropriate school staff and 30 volunteers are trained in first aid, cardiopulmonary 31 resuscitation, and AED use in a manner that follows evidence 32 based guidelines set forth by the American Heart Association, 33 or other nationally recognized guidelines focused on 34 emergency cardiovascular care. 35 (c) The principal of a school maintained by a school 36 corporation, charter school, or state accredited nonpublic school 37 shall manage the venue specific emergency action plan for sudden 38 cardiac arrest. 39 SECTION 4. [EFFECTIVE JULY 1, 2025] (a) The department of 40 education shall conduct a statewide survey of school corporations, 41 charter schools, and state accredited nonpublic schools to 42 determine: 2025 IN 350—LS 7350/DI 152 4 1 (1) the number of automated external defibrillators (AEDs) 2 owned before July 1, 2025, by the schools; 3 (2) the location of each AED in the schools; 4 (3) whether, as of July 1, 2025, the schools have a venue 5 specific emergency action plan for sudden cardiac arrest (as 6 defined in IC 20-34-8-3.5, before its amendment by this act); 7 and 8 (4) the specific school events at which AEDs are present as of 9 July 1, 2025. 10 (b) Each school corporation, charter school, and state 11 accredited nonpublic school shall respond to the statewide survey 12 described in subsection (a) not later than July 31, 2025. 13 (c) The department of education shall compile the results of the 14 survey described in subsection (a) in a report. The department of 15 education shall: 16 (1) publish the report on the department's website; and 17 (2) submit the report to the legislative council in an electronic 18 format under IC 5-14-6; 19 not later than October 31, 2025. 20 (d) This SECTION expires January 1, 2027. 2025 IN 350—LS 7350/DI 152
