Rogers BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED:XGENERAL IMPACT: State & Local DEDICATED FEDERAL Summary of Legislation: This bill provides that certain funding provided to a local board of health may be used to provide automated external defibrillators (AEDs) to school corporations, charter schools, and state accredited nonpublic schools. The bill revises the definition of "venue specific emergency action plan for sudden cardiac arrest" (plan) and revises the requirements of a plan. The bill requires a local health department (department) to develop a plan for certain schools and provide support for the plan, if requested by the school. The bill requires the Department of Education (DOE) to conduct a statewide survey of school corporations, charter schools, and state accredited nonpublic schools concerning: (1) plans developed prior to July 1, 2025; and (2) AEDs. Effective Date: July 1, 2025. Explanation of State Expenditures: DOE Survey: DOE is tasked to conduct a statewide survey of public and accredited nonpublic schools regarding the number and location of AEDs and whether emergency action plans have been developed. DOE will compile and report its findings to the Legislative Council and publish its findings on the DOE website no later than October 31, 2025. This requirement constitutes a one-time workload increase on DOE and should be able to be completed within existing resources. Explanation of State Revenues: Explanation of Local Expenditures: Local Public Health Fund: This bill authorizes but does not require money granted to a local public health board to be used to provide AEDs to schools in accordance with an emergency action plan developed in cooperation between the board and the school. This provision allows additional flexibility in how money from the local public health fund is used, but it does not increase the total amount of expenditures by boards. Cardiac Arrest Plans: This bill requires local health departments to help eligible schools develop and SB 350 1 implement, and, if requested by the school, sustain, their cardiac arrest plans. This workload increase could be completed with existing staff and resources. Public schools that choose to develop and implement cardiac arrest plans will be able to request assistance from their respective local health departments, reducing their workload and/or costs to complete that process. Schools may also request funding to purchase AEDs, which typically cost between $1,500 and $2,500 each. These reduced costs are likely to encourage schools that have not yet done so to develop plans and field AEDs. AEDs require periodic maintenance and replacement of batteries and electrode pads, but those costs should be met with existing resources. DOE Survey: Public schools will have to complete the survey DOE will conduct under provisions of this plan no later than July 31, 2025.
