Synopsis:  Automated external defibrillator requirements. Provides that
certain funding provided to a local board of health may be used to
provide automated external defibrillators (AEDs) to school
corporations, charter schools, and state accredited nonpublic schools.
Revises the definition of "venue specific emergency action plan for
sudden cardiac arrest" (plan) and revises the requirements of a plan.
Requires the department of education to develop a plan for certain
schools and provide support for the plan, if requested by the school.
Requires the department of education to conduct a statewide survey of
school corporations, charter schools, and state accredited nonpublic
schools concerning: (1) plans developed prior to July 1, 2025; and (2)
AEDs.

SENATE BILL No. 350
A BILL FOR AN ACT to amend the Indiana Code concerning
education.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 16-46-10-3, AS AMENDED BY P.L.164-2023,
2 SECTION 47, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3 JULY 1, 2025]: Sec. 3. (a) Funding provided a local board of health
4 under section 2.2 or 2.3 of this chapter may be used by the local board
5 to provide any of the following services:
6 (1) Core public health services.
7 (2) Any statutorily required actions for a local health department.
8 (3) Evidence based programs to prevent or reduce the prevalence
9 of health issues or improve the health and behavioral health of
10 Indiana residents as outlined in the plan described in
11 IC 16-30-3-2.
12 (4) The provision of automated external defibrillators (AEDs)
13 to school corporations, charter schools, and state accredited
14 nonpublic schools pursuant to each school corporation's,
15 charter school's, and state accredited nonpublic school's
16 venue specific emergency action plan for sudden cardiac
17 arrest (as defined in IC 20-34-8-3.5) developed by the

1 department of education, in collaboration with a local health
2 department under IC 20-34-8-4.5.
3 (b) Money granted a local board of health from the local public
4 health fund may not be used for any purpose other than for the services
5 listed in this section.
6 (c) A county may not use more than ten percent (10%) of the funds
7 received under section 2.2 or 2.3 of this chapter during a fiscal year for
8 capital expenditures, including:
9 (1) the purchase, construction, or renovation of buildings or other
10 structures;
11 (2) land acquisition; and
12 (3) the purchase of vehicles and other transportation equipment.
13 (d) Funds used for capital expenditures under subsection (c) must
14 be included on the annual financial report required under section 2.2(f)
15 or 2.3(c) of this chapter and posted on the local health department's
16 website.
17 (e) Before funds may be used to hire or contract for the provision or
18 administration of core public health services, the local health
19 department shall post the position or contract to the public for at least
20 thirty (30) days.
21 SECTION 2. IC 20-34-8-3.5, AS ADDED BY P.L.187-2023,
22 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
23 JULY 1, 2025]: Sec. 3.5. As used in this chapter, "venue specific
24 emergency action plan for sudden cardiac arrest" means a plan
25 developed used by a school corporation, charter school, or state
26 accredited nonpublic school that
27 (1) includes detailed written instructions regarding how to
28 respond to sudden cardiac arrest; and
29 (2) indicates the location of the nearest automated external
30 defibrillator (AED) at the venue.

32 setting.
33 SECTION 3. IC 20-34-8-4.5 IS ADDED TO THE INDIANA CODE
34 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
35 1, 2025]: Sec. 4.5. (a) For the 2025-2026 school year, the
36 department, in collaboration with a local health department
37 (established under IC 16-20) located within a district in which a
38 school corporation, charter school, or state accredited nonpublic
39 school is located, shall do the following:
40 (1) Develop a venue specific emergency action plan for sudden
41 cardiac arrest in collaboration with the school corporation,
42 charter school, or state accredited nonpublic school.

1 (2) Provide ongoing support to the school corporation, charter
2 school, or state accredited nonpublic school for the venue
3 specific emergency action plan for sudden cardiac arrest
4 described in subdivision (1), if support is requested by the
5 school.
6 (b) A venue specific emergency action plan for sudden cardiac
7 arrest developed under this section must include the following:
8 (1) A cardiac emergency response plan (CERP) that includes
9 the core elements set forth by either the American Heart
10 Association or other nationally recognized recommendations,
11 including recommendations set by the National Athletic
12 Trainers Association.
13 (2) A requirement that the CERP be widely distributed and
14 posted throughout the school, rehearsed frequently, and
15 updated annually.
16 (3) A requirement that automated external defibrillators
17 (AEDs) must be clearly marked and easily accessible at each
18 venue where an athletic activity may occur, or within one (1)
19 to three (3) minutes of where each athletic activity is held.
20 AEDs must be placed in accordance with guidelines set by the
21 American Heart Association, or other nationally recognized
22 guidelines focused on emergency cardiovascular care.
23 (4) A requirement that the governing authority of a school
24 corporation or the equivalent authority of a charter school or
25 state accredited nonpublic school work directly with local
26 providers of emergency medical services (as defined in
27 IC 16-18-2-110) to integrate the CERP into the community's
28 local provider protocols.
29 (5) A requirement that AEDs must be made available for use
30 by all individuals, regardless of an individual's training.
31 (6) A requirement that appropriate school staff and
32 volunteers are trained in first aid, cardiopulmonary
33 resuscitation, and AED use in a manner that follows evidence
34 based guidelines set forth by the American Heart Association,
35 or other nationally recognized guidelines focused on
36 emergency cardiovascular care.
37 (c) The principal of a school maintained by a school
38 corporation, charter school, or state accredited nonpublic school
39 shall manage the venue specific emergency action plan for sudden
40 cardiac arrest.
41 SECTION 4. [EFFECTIVE JULY 1, 2025] (a) The department of
42 education shall conduct a statewide survey of school corporations,

1 charter schools, and state accredited nonpublic schools to
2 determine:
3 (1) the number of automated external defibrillators (AEDs)
4 owned before July 1, 2025, by the schools;
5 (2) the location of each AED in the schools;
6 (3) whether, as of July 1, 2025, the schools have a venue
7 specific emergency action plan for sudden cardiac arrest (as
8 defined in IC 20-34-8-3.5, before its amendment by this act);
9 and
10 (4) the specific school events at which AEDs are present as of
11 July 1, 2025.
12 (b) Each school corporation, charter school, and state
13 accredited nonpublic school shall respond to the statewide survey
14 described in subsection (a) not later than July 31, 2025.
15 (c) The department of education shall compile the results of the
16 survey described in subsection (a) in a report. The department of
17 education shall:
18 (1) publish the report on the department's website; and
19 (2) submit the report to the legislative council in an electronic
20 format under IC 5-14-6;
21 not later than October 31, 2025.
22 (d) This SECTION expires January 1, 2027.
