Ireland FUNDS AFFECTED:XGENERAL IMPACT: State & Local XDEDICATED FEDERAL Summary of Legislation: This bill establishes a procedure for the transfer of an inmate from a county jail to another county jail or the Department of Correction if the inmate: (1) poses a serious risk of escape; (2) demonstrates violent or aggressive behavior; or (3) needs to be protected from other inmates. Effective Date: July 1, 2025. Explanation of State Expenditures: The Department of Corrections (DOC) indicates that many of these policies and procedures proposed in this bill already exist. Any additional policy and procedural accommodations could likely be made with existing resources. DOC reports that there are approximately 15 offenders identified as high risk persons. Additional Information - While the bill does not specify how the average daily cost is determined, OFMA examined the average per diem costs of DOC facilities for FY 2024. The average operating cost per diem for all facilities was $78.99 and the average capital per diem was $0.64. (The capital per diem includes lease payments and other capital projects). The average per diem costs between correctional facilities range between $59.43 and $97.56. Currently, reimbursement to county sheriffs receive $37.50 per day for each Level 6 felon and felony offenders sentenced to DOC facilities and still remain in county jails after 5 days. The Indiana Criminal Justice Institutes report that offenders waiting to be transferred to the DOC increased by 15%, while convicted Level 6 felons serving time in jail decreased by 18% during FY 2024. Explanation of State Revenues: Explanation of Local Expenditures: County Jails: Sheriffs should be able to make these transfers with existing resources and staffing levels. Trial Courts: Courts of jurisdiction may hold additional hearings to confirm and order the reassignment of SB 420 1 a potential qualifying offender.
