BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED:XGENERAL IMPACT: State DEDICATED FEDERAL Summary of Legislation: This bill provides that the governing documents of a homeowners association (HOA) may authorize any vote to be conducted by electronic means. It requires an HOA to send certain notices to members of the HOA. It also requires an HOA to send a certain notice to the Attorney General. This bill requires an HOA to create and maintain a website that includes certain information. This bill requires the Attorney General to establish a training course that members of a HOA must complete. Effective Date: July 1, 2025. Explanation of State Expenditures: Attorney General: This bill requires the Attorney General or their designee establish an online mandatory training course that new members of an HOA board must complete within their first year of being on the board. The Attorney General would be required to adopt rules in order to implement this training course. These requirements represent an additional workload [and/or expenditure] on the agency outside of the agency’s routine administrative functions, and existing staffing and resource levels, if currently being used to capacity, may be insufficient for full implementation. The additional funds and resources required could be supplied through existing staff and resources currently being used in another program or with new appropriations. Ultimately, the source of funds and resources required to satisfy the requirements of this bill will depend on legislative and administrative actions.
