Brown L BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED:XGENERAL IMPACT: State & Local DEDICATED FEDERAL Summary of Legislation: This bill provides that a county recorder may not disclose recorded documents containing identifying information of an address confidentiality program participant, unless: (1) the participant provides written consent; and (2) the participant's name is redacted. It provides that a person seeking disclosure of a shielded document who: (1) is denied disclosure by the county recorder; or (2) requires an unredacted copy for the person's intended use in the normal course of business; must contact the Attorney General to contact the program participant about consenting to disclosure. The bill also provides that if the program participant does not take action within five days after being contacted by the attorney general, the request for disclosure is automatically denied. Effective Date: July 1, 2025. Explanation of State Expenditures: Attorney General: This bill’s provisions will result in an increase in the administrative workload for the Attorney General as a result of the following: • Developing a form that an individual would use for requesting disclosure of a shielded document from a county recorder • Receiving notifications and supporting documentation from county recorders, regarding their decision on whether to disclose shielded documents • Receiving requests to obtain a shielded document from individuals who were denied approval of the information from the county recorder • Contacting participants in the Address Confidentiality Program to ascertain their consent with disclosure of the shielded document to the requestor Explanation of State Revenues: Explanation of Local Expenditures: This bill’s provisions will result in an increase in the administrative workload for county recorders since they would need to do further due diligence on any recorded documents that contain identifying information of program participants and ensure that these documents are not disclosed, except if provided the written consent of the program participants - as specified in this bill - to SB 489 1 disclose the information. Additionally, county recorders would be required to notify the Attorney General about their determination on whether or not to disclose a shielded document to a requestor.
