 SUBJECT: Fiscal Note for HB 2068 by House Committee on Corrections and Juvenile 
Justice 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning HB 2068 is 
respectfully submitted to your committee. 
 
 HB 2068 would allow a court to direct a person convicted of a crime committed while on 
release for a felony to serve the sentence concurrently or consecutively.  Under current law, the 
sentence is served consecutively.  The bill would also modify how certain prior convictions are 
counted for special sentencing rules related to possession of a controlled substance. 
 
 The Kansas Sentencing Commission states enactment of the bill would have an effect on 
prison admissions and beds; however, the Commission cannot provide an estimate of what that 
effect would be.  The Department of Corrections and the Office of Judicial Administration indicate 
enactment of the bill would not have a significant fiscal effect.  Any fiscal effect associated with 
HB 2068 is not reflected in The FY 2024 Governor’s Budget Report.
