HB 2068 would allow a court to direct a person convicted of a crime committed while on release for a felony to serve the sentence concurrently or consecutively. Under current law, the sentence is served consecutively. The bill would also modify how certain prior convictions are counted for special sentencing rules related to possession of a controlled substance. The Kansas Sentencing Commission states enactment of the bill would have an effect on prison admissions and beds; however, the Commission cannot provide an estimate of what that effect would be. The Department of Corrections and the Office of Judicial Administration indicate enactment of the bill would not have a significant fiscal effect. Any fiscal effect associated with HB 2068 is not reflected in The FY 2024 Governor’s Budget Report. Sincerely, Adam Proffitt Director of the Budget cc: Scott Schultz, Sentencing Commission Randy Bowman, Department of Corrections Vicki Jacobsen, Judiciary
