HB 2147 would add “abandoned or towed vehicles” to the list of vehicles that do not need to be registered when a public agency or person providing wrecker or towing service is in possession of a vehicle and applies for a certificate of title for the purpose of selling the vehicle. The bill would outline a process by which a public agency that has impounded a vehicle would transfer the certificate of title to the highest cash bidder at a public auction. The bill would also prohibit the sale of an impounded vehicle by a public agency or an abandoned or towed vehicle by a wrecker or towing service prior to receiving a certificate of title from the Division of Vehicles. The bill would exempt a public agency or person providing wrecker or towing services from certain statutory provisions regarding the impounding and disposition of abandoned and towed vehicles if such agency or person sells more than five vehicles in a calendar year. The Department of Revenue indicates enactment of the bill would have no fiscal effect on the agency but would require updates to policies and procedures and the TR-85 possessory lien affidavit as well as retraining for and communication with towing companies, counties, the Kansas Vehicle Title Services Company, the Kansas Highway Patrol and their designees, other government agencies, and departmental staff.
