SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2167

Brief*
HB 2167, as amended, would prohibit the use of 
cryptocurrency for campaign contributions and would amend 
law to prohibit a candidate or candidate committee from using 
campaign contributions subject to reporting requirements 
under the Campaign Finance Act in or for the campaign of a 
candidate for federal office. 
[Note: Current law prohibits any campaign funds from 
being used for the campaign of a candidate for federal office.]
Background
The bill was introduced by the House Committee on 
Elections at the request of Representative Waggoner on 
behalf of the Governmental Ethics Commission.

In the House Committee hearing, proponent testimony 
was provided by the Executive Director of the Governmental 
Ethics Commission, who stated the bill would regulate 
campaign finance contributions in the form of cryptocurrency 
and create an exception to a broader prohibition involving 
parties and political action committees supporting federal 
candidates.
No other testimony was provided.

Fiscal Information
According to the fiscal note prepared by the Division of 
the Budget on the bill, as introduced, the Secretary of State 
indicates that the office would use existing resources to make 
changes to its campaign finance filing system. The 
Governmental Ethics Commission indicates it could have 
additional costs related to opinion publishing; however, the 
fiscal effect would be negligible. Any fiscal effect associated 
with the bill is not reflected in The FY 2024 Governor’s 
Budget Report.
