Dear Representative Patton: 
 
 SUBJECT: Fiscal Note for HB 2172 by House Committee on Judiciary 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning HB 2172 is 
respectfully submitted to your committee. 
 
 HB 2172 would enact the Uniform Trust Decanting Act.  The bill would apply to an express 
trust that is irrevocable or revocable by the settlor only with the consent of the trustee or a person 
holding an adverse interest. The details of the Act are outlined in the bill.   
 
 The Office of Judicial Administration indicates enactment of the bill could have a fiscal 
effect on the Judicial Branch because the bill’s provisions would authorize court actions pursuant 
to the Act.  The Office anticipates there would be litigation over such actions, which would 
increase the time spent by judges and court employees processing and researching these cases.  
The Judicial Branch states enactment of the bill could result in the collection of docket fees for 
those cases filed under the bill’s provisions, which would be credited to the State General Fund.  
The Office states a fiscal effect cannot be estimated until the Judicial Branch has had an 
opportunity to operate under the bill’s provisions.  Any fiscal effect associated with HB 2172 is 
not reflected in The FY 2024 Governor’s Budget Report.
