 SUBJECT: Fiscal Note for HB 2607 by House Committee on Agriculture and Natural 
Resources 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning HB 2607 is 
respectfully submitted to your committee. 
 
 HB 2607 would amend the current Kansas Pesticide Law and Kansas Chemigation Safety 
Law.  The bill would enhance requirements for pesticide applicator education and safety, establish 
additional categories of licensure and certification including pesticide applications of sodium 
cyanide for predator control, provide mandatory training for uncertified applicators, and establish 
record keeping requirements.  Additionally, the bill would update provisions relating to civil and 
criminal penalties for violations and require licensees and applicants to provide a certificate of 
liability insurance for proof of financial responsibility that is required under current law.  Finally, 
the bill would eliminate the requirement of the Department of Agriculture to complete a 
determination of “sufficient rehabilitation” before issuing a license or certification to an individual 
that has self-reported a prior felony conviction. 
 
 The Department of Agriculture indicates the enactment of HB 2607 could increase agency 
fee revenue in both FY 2025 and FY 2026 with the addition of the licensure and certification of 
sodium cyanide applications; however, the Department cannot estimate a fiscal effect as it cannot 
accurately determine if current commercial applicators would choose the new method.  The Kansas 
Department of Health and Environment indicates the enactment of HB 2607 would not have a 
fiscal effect on the agency.  Any fiscal effect associated with HB 2607 is not reflected in The FY 
2025 Governor’s Budget Report.
