HB 2792 would prohibit gender transition surgeries on minors and a violation would be considered unprofessional conduct under KSA 65-2837. The bill would make related definitions. In addition, the bill would require transgender care services and treatments to be conducted according to the clinical practice guidelines specified in Wylie C. Hembree et al., “Endocrine Treatment of Gender-Dysphoric/Gender-Incongruent Person: An Endocrine Society Clinical Practice Guidelines.” According to the Kansas State Board of Healing Arts, enactment of HB 2792 could increase actionable complaints, but a total fiscal effect cannot be estimated. The agency anticipates handling any additional complaints within existing resources. The Kansas Attorney General’s Office states that enactment of the bill would not result in a fiscal effect for the agency. The agency notes that the bill could be challenged in court, but a related fiscal effect cannot be estimated. The Behavioral Sciences Regulatory Board states that if there were additional disciplinary complaints related to enactment of the bill, it would necessitate additional staff time to investigate these complaints, however the agency is unable to estimate the increase in staff time and anticipates these investigations could be absorbed in existing resources. The Kansas State Board of Nursing indicates that passage of HB 2792 would not result in additional expenditures or revenues for the agency.
