SB 106 would create the class A nonperson misdemeanor crime of knowingly or intentionally manufacturing, importing, distributing, selling, offering for sale, installing, or reinstalling a supplemental restraint system component that is counterfeit, does not meet federal guidelines, or is non-functional. The Office of Judicial Administration indicates enactment of the bill could increase the number of cases filed in district court because it creates a new crime. This would increase the time spent by district court judicial and nonjudicial personnel in processing, researching, and hearing cases. Since the crime carries a misdemeanor penalty, there could also be more supervision of offenders required by court services officers. Enactment of the bill could also result in the collection of supervision fees, docket fees, and fines in cases filed under the provisions of the bill. However, a fiscal effect cannot be determined because the number of additional cases cannot be estimated. The Department of Transportation indicates enactment of the bill would increase revenue to the Traffic Records Enhancement Fund and the Seat Belt Safety Fund from fines collected under the new infraction. However, any increase is expected to be negligible. Any fiscal effect associated with SB 106 is not reflected in The FY 2024 Governor’s Budget Report.
