SUBJECT: Fiscal Note for SB 15 by Senate Committee on Financial Institutions and
Insurance
In accordance with KSA 75-3715a, the following fiscal note concerning SB 15 is
respectfully submitted to your committee.
Under current law, an insurance company is required to make a written demand to an agent
or broker in order to establish prima facie evidence that an agent or broker used or applied the
premium for a purpose other than paying the company. SB 15 would remove the requirement of
a written demand to establish prima facie evidence.
The Kansas Insurance Department, the Kansas Department of Corrections, and the Kansas
Judicial Branch all state that SB 15 would not have a fiscal effect.
