Dear Senator Warren: 
 
 SUBJECT: Fiscal Note for SB 187 by Senator Haley 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning SB 187 is 
respectfully submitted to your committee. 
 
 SB 187 would amend laws relating to wrongful conviction and imprisonment.  A claimant 
would be entitled to receive interest on the damages from the date the suit for the claim was filed 
at a rate provided for interest on judgments in KSA 16-204.  When a judgment has been entered, 
the Attorney General would seek to recover damages for the state of Kansas for the benefit of the 
State General Fund from any person who knowingly contributed to the wrongful conviction and 
imprisonment of a claimant. The Attorney General would prosecute ouster and criminal 
proceedings as the evidence in the case warrants.  
 
 The Office of the Attorney General states that the bill would require $143,914 from the 
State General Fund in FY 2024 to administer the prejudgment interest provision and the 
requirements to attempt to collect damages in certain cases.  Of that amount, $129,385 would be 
for salaries and wages for 1.00 Attorney FTE position and $14,529 would be for operating 
expenditures. 
 
 The Judicial Branch indicates that the bill could have a negligible effect on its expenditures 
and revenues, which could be absorbed within existing resources.  Any fiscal effect associated 
with SB 187 is not reflected in The FY 2024 Governor’s Budget Report.

 The League of Kansas Municipalities and the Kansas Association of Counties both state 
that the bill would not have a fiscal effect.
