Session of 2023 SENATE BILL No. 201 By Committee on Federal and State Affairs 2-7 AN ACT concerning adult-oriented businesses; relating to drag shows; prohibiting the expenditure of any state moneys for drag shows targeting minors; providing criminal penalties for violations of the act. Be it enacted by the Legislature of the State of Kansas: Section 1. (a) No moneys appropriated from the state general fund or from any special revenue fund shall be expended for the production or performance of any drag show that has a primary audience consisting of individuals under 18 years of age. (b) It is a violation of this section to knowingly expend moneys in violation of subsection (a). Violation of this section by an individual is a class B nonperson misdemeanor. (c) No moneys appropriated from the state general fund or from any special revenue fund shall be distributed to or otherwise expended by any state agency or any political subdivision of this state for a period of three years if any officer, employee or agent of such state agency or political subdivision has been convicted of a violation of this section. Such three- year period shall commence on the date of such conviction. (d) As used in this section, the term "drag show" means a performance in which one or more performers: (1) Exhibits a gender identity that is different from the performer's gender assigned at birth using clothing, makeup or other accessories that are traditionally worn by members of and are meant to exaggerate the gender identity of the performer's opposite sex; and (2) sings, lip-synchs, dances or otherwise performs for entertainment before an audience that consists primarily of individuals under 18 years of age, whether performed for payment or not.
