Dear Senator Gossage: 
 
 SUBJECT: Fiscal Note for SB 206 by Senators Holland and Francisco 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning SB 206 is 
respectfully submitted to your committee. 
 
 SB 206 would create the Medical Autonomy/Accessibility and Truth Act.  The bill would 
amend tax provisions to allow for tax benefits for certain health services and expenses related to 
abortion and would allow for certain insurance coverages of abortions.  The bill would also remove 
provisions related to statements of risks associated with abortions and remove provisions 
preventing school districts from permitting persons or entities that provide abortion services to 
offer, sponsor, or otherwise furnish course materials or instruction relating to human sexuality or 
sexually transmitted diseases.  State agencies would be prohibited from discriminating against any 
individual or institutional health care entity on the basis of whether or not such entity provides, 
pays for, or refers patients for abortions. In addition, the bill would remove abortion restrictions 
for the University of Kansas Hospital Authority and would remove certain abortion-related 
prohibitions on state facilities and use of state funds.    
 
 According to the Kansas Insurance Department, the Kansas Department of Health and 
Environment, and the University of Kansas Medical Center, enactment of SB 206 would not result 
in a fiscal effect on the operations of any of the respective agencies. The Kansas Department of 
Revenue states passage of the bill would have a negligible effect on state taxes and State General 
Fund receipts. The Kansas State Board of Healing Arts reports the bill could result in increased 
complaints, resulting in investigation and litigation, but the agency anticipates handling any 
increased workload within existing resources. The Kansas State Department of Education  The Honorable Beverly Gossage, Chairperson

anticipates a negligible fiscal effect on the agency and school districts. Any fiscal effect associated 
with SB 206 is not reflected in The FY 2024 Governor’s Budget Report.
