Dear Senator Gossage: 
 
 SUBJECT: Fiscal Note for SB 213 by Senator Francisco 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning SB 213 is 
respectfully submitted to your committee. 
 
 SB 213 would remove the definition of “health care provider,” which means any person 
licensed by the State Board of Healing Arts, from the Kansas Health Information Technology Act. 
For medical records requests related to a claim for social security disability, workers 
compensation, medical malpractice, or personal injury, the bill would prohibit health care 
providers from charging a fee for records requested by the authorized representative of a patient 
or former patient that is greater than the amount the healthcare provider would charge if the records 
were requested personally pursuant to Public Law 111-5, Section 13405.    
 
 According to the Kansas Department of Health and Environment and the Kansas State 
Board of Healing Arts, enactment of SB 213 would not result in a fiscal effect on the operations 
for either agency.
