SUBJECT: Fiscal Note for SB 354 by Senate Committee on Public Health and Welfare
In accordance with KSA 75-3715a, the following fiscal note concerning SB 354 is
respectfully submitted to your committee.
SB 354 would designate facilities where elective abortions are performed as being
ineligible to purchase professional liability insurance from the Healthcare Stabilization Fund. The
bill would also require any facility where elective abortions are performed, as a condition of
licensure, to maintain continuous professional liability insurance coverage equivalent to that
provided by the Healthcare Stabilization Fund. As requested by the Healthcare Stabilization Board
of Governors, the facility would have to submit proof of private liability insurance coverage.
The Healthcare Stabilization Fund and the Kansas Insurance Department state that
enactment of SB 354 would have no fiscal effect on agency operations.
