Dear Senator Warren: 
 
 SUBJECT: Fiscal Note for SB 392 by Senate Committee on Judiciary 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning SB 392 is 
respectfully submitted to your committee. 
 
 SB 392 would give the Office of Medicaid Inspector General access to the prescription 
monitoring program database without a warrant to conduct drug-related audits and investigations.  
The bill would also replace an Advisory Committee board member from the Kansas Bureau of 
Investigation with a person from the Office of the Attorney General.    
 
 The Board of Pharmacy indicates that any additional expenditures to onboard the Office of 
the Attorney to receive K-TRACS program data and ensure the appropriate and timely delivery 
and use of the data would be dependent upon the number of requests.  However, the agency 
estimates the additional expenditures could be absorbed within existing resources.   
 
 The Office of the Attorney General and the Kansas Bureau of Investigation both state that 
the bill would not have a fiscal effect on agency operations.  Any fiscal effect associated with SB 
392 is not reflected in The FY 2025 Governor’s Budget Report.
