SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2020
As Amended by House Committee on Elections
Brief*
HB 2020 would direct the Director of Vehicles (Director), 
Department of Revenue, to quarterly provide the Secretary of 
State (Secretary) a list of all permanent and temporary 
drivers’ licenses issued to noncitizens. The list of noncitizens 
must contain the names, addresses, phone numbers, Social 
Security numbers, alien registration numbers, dates of birth, 
temporary driver’s license numbers, and the expiration dates 
of such licenses. The bill would direct the Secretary to 
compare the list provided by the Director with the voter 
registration rolls and investigate. The Secretary would then 
direct the county election officer to remove the names of any 
noncitizens that appear on the voter registration rolls within 
five business days. The bill would require the county election 
officer to notify such person that they may be reinstated on 
the voter registration rolls by providing proof of their 
citizenship.
Background
The bill was introduced by the House Committee on 
Elections at the request of Representative Waggoner.

In the House Committee hearing, representatives of the 
Office of the Secretary of State and Opportunity Solutions 
Project provided proponent testimony. The proponents 
generally stated the bill would streamline a process already in 
place and would allow a proactive approach to ensuring 
secure and safe elections.
Written-only proponent testimony was submitted by 
three private citizens.
A representative of Loud Light Civic Action presented 
opponent testimony, stating the bill was declarative, vague, 
and risked constitutional challenges.
Written-only opponent testimony was submitted by a 
representative of the American Civil Liberties Union of 
Kansas.
Written-only neutral testimony was submitted by three 
private citizens.
No other testimony was provided.
The House Committee amended the bill to:
●Specify that the list provided by the Director is a list 
of noncitizens;
●Add alien registration registration numbers to the 
list provided by the Director;
●Direct the Secretary, after an investigation, to direct 
the county election officer to remove any noncitizen 
from the voter registration rolls;
●Direct the county election officer to send 
notification to persons removed from the voter 
registration rolls; and
2- 2020 ●Add a requirement that the county election officers 
must remove noncitizens from the voter registration 
rolls within five business days.
Fiscal Information
According to the fiscal note prepared by the Division of 
the Budget on the bill, as introduced, the Secretary of State 
would use existing resources to review the quarterly list and 
perform any additional activities as a result of the review. The 
Department of Revenue would require $1,250 from the State 
General Fund in FY 2026 for programming and testing 
required to produce the quarterly report for the Secretary of 
State.
Any fiscal effect associated with the bill is not reflected 
in The FY 2026 Governor's Budget Report.
The Kansas Association of Counties indicates 
enactment of HB 2020 would not have a fiscal effect on 
counties.
