 HOUSE BILL NO. 2030

Brief*
HB 2030 would exempt dealers and manufacturers of trailers from specified provisions of 
the Vehicle Dealers and Manufacturers Licensing Act. The exemptions would not apply to 
dealers and manufacturers of semitrailers or travel trailers or to a dealer in the sale or exchange 
of any type of vehicle other than trailers.
The provisions from which the non-exempt trailer dealers and manufacturers would be 
exempt deal with termination of a franchise agreement, correction of warranty defects, change 
of ownership of a dealership, liability for defects, location of dealerships, disputes between 
dealers and manufacturers, the definition of “delivery” of a vehicle, and manufacturer 
requirements of dealers regarding facilities and signs.
Conference Committee Action
The Conference Committee agreed to remove a provision making the bill effective upon 
publication in the Kansas Register.
Background
The bill was requested by Representative Hoheisel on behalf of Catalyst.

House Committee on Transportation
In the House Committee hearing, proponent testimony was provided by a representative 
of American Trailer World, who noted the trailers covered by the bill are not motorized, only 
being hauled or drawn, and would not include trailers with living quarters. He suggested an 
amendment to the bill to clarify to whom the exceptions would apply.

1 - 2030  A representative of the Division of Vehicles, Kansas Department of Revenue, provided 
neutral testimony, noting the bill would loosen requirements for businesses that sell trailers but 
not vehicles that tow trailers.
No other testimony was provided.
The House Committee amended the bill to clarify that the exemptions would not apply to 
dealers and manufacturers of semitrailers or travel trailers and to a dealer in the sale or 
exchange of any type of vehicle other than trailers.
Senate Committee on Transportation
In the Senate Committee hearing, a representative of American Trailer World provided 
proponent testimony, stating the bill would exempt trailers that are not motorized and thereby 
make it easier for trailer manufacturers to operate in Kansas. The proponent also stated that the 
bill would make Kansas requirements regarding sales of non-motorized trailers more consistent 
with requirements of other states.
No other testimony was provided.
The Senate Committee amended the bill to make the effective date to be upon publication 
in the Kansas Register. [Note: The Conference Committee did not retain this amendment.]
Fiscal Information
According to the fiscal note prepared by the Division of the Budget on the bill, as 
introduced, the Kansas Department of Revenue indicates it would require a total of $3,220 from 
the State General Fund in FY 2026 to modify an agency database and publication. The Kansas 
Department of Transportation indicates enactment of the bill would not have a fiscal effect on 
agency operations. Any fiscal effect associated with enactment of the bill is not reflected in The 
FY 2026 Governor’s Budget Report.
