SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2031

Brief*
HB 2031, as amended, would allow a driving school or 
motorcycle instructor who meets other requirements in 
continuing law to hold a valid driver’s license from any state, 
not solely a Kansas license as in current law. The bill would 
require a motorcycle instructor to hold a class M driver’s 
license or motorcycle license equivalent from another state to 
instruct in Kansas.
Background
The bill was introduced by the House Committee on 
Transportation at the request of Representative Resman on 
behalf of a constituent.
House Committee on Transportation
In the House Committee hearing, representatives of 
ABATE of Kansas and Rawhide Harley Davidson provided 
proponent testimony. The proponents stated there is a 
shortage of motorcycle driving instructors in Kansas, and this 
bill would allow instructors who have the required instructor 
training and credentials through national programs such as 
the Motorcycle Safety Foundation (MSF), but who do not hold 
a Kansas motorcycle license, to teach in Kansas.

Representative Resman, a representative of Johnson County 
Community College, and one private citizen.
Neutral testimony was provided by the Director of 
Government Affairs, Kansas Department of Revenue 
(KDOR), who suggested the requirement for a driving school 
instructor to hold a Kansas driver’s license be amended to 
allow driving instructors from other states with the proper 
certification to be able to instruct in Kansas. They stated this 
would maintain consistency in the statute for driving school 
instructors. [Note: The bill as introduced would have 
authorized only a motorcycle instructor to hold a license from 
another state.]
The House Committee amended the bill to permit a 
driving school instructor to hold a valid driver’s license issued 
by any state.
Fiscal Information
According to the fiscal note prepared by the Division of 
the Budget on the bill, as introduced, KDOR and the 
Department of Transportation indicate enactment of the bill 
would not have a fiscal effect.
