SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2101
As Amended by House Committee of the Whole
Brief*
HB 2101, as amended, would prohibit cities and 
counties from adopting an ordinance or enforcing a resolution 
that establishes or provides for the operation of a guaranteed 
income program that uses tax revenue unless the Legislature, 
by an act, expressly consents to and approves of such 
program. The bill would render any such prohibited ordinance 
or resolution adopted prior to July 1, 2025, null and void.
The bill would define “guaranteed income” to mean a 
program that is not expressly required by federal law or 
regulation and provides individuals with regular periodic cash 
payments.
Background
The bill was introduced by the House Committee on 
Welfare Reform at the request of Representative Awerkamp.

In the House Committee hearing on February 6, 2025, a 
representative of the Opportunity Solutions Project provided 
proponent testimony citing the need to prevent guaranteed 
income programs due to concerns regarding the impact of 
such programs on the workforce and governmental spending 
and on their overall economic impact.

Opponent testimony was provided by a representative 
of the Kansas League of Municipalities, citing issues of 
preemptive legislation and state constitutional concerns and 
restrictions on future governmental assistance.

Association of Counties; and by a private citizen.
House Committee of the Whole
The House Committee of the Whole amended the bill to 
require the approval and consent of the Legislature for a 
guaranteed income program that uses tax revenue and to 
amend the definition of a guaranteed income program.
Fiscal Information
According to the fiscal note prepared by the Division of 
the Budget on the bill, as introduced, the League of Kansas 
Municipalities reports that enactment of the bill would not 
have a fiscal effect for cities. The Kansas Association of 
Counties states that no counties currently utilize a guaranteed 
income program so there is no fiscal effect on counties, but it 
notes the legislation is preemptive and a future fiscal effect 
could not be estimated.
