SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2155
As Amended by Senate Committee on Judiciary
Brief*
HB 2155, as amended, would specify that sheriffs have 
liability for official acts of the sheriff and sheriff’s sureties 
related to the charge and custody of county jails. The bill also 
makes technical changes to update outdated language.
The bill would be in effect upon publication in the 
Kansas Register.
Background
The bill was introduced by the House Committee on 
Judiciary at the request of a representative of the Kansas 
Sheriffs Association.
House Committee on Judiciary
In the House Committee hearing, proponent testimony 
was provided by a representative of the Kansas Association 
of Chiefs of Police and Kansas Sheriffs Association. The 
proponent generally stated the bill would align the statute with 
other similar statutes and Kansas case law.

In the Senate Committee hearing, the representative of 
the Kansas Association of Chiefs of Police and Kansas 
Sheriffs Association provided proponent testimony that was 
substantially similar to the testimony provided in the House 
Committee hearing.
Written-only opponent testimony was provided by a 
representative of the Kansas Trial Lawyers Association.
No other testimony was provided.
The Senate Committee adopted an amendment to make 
the bill effective upon publication in the Kansas Register.
Fiscal Information
According to the fiscal note prepared by the Division of 
the Budget on the bill, as introduced, the Judicial Branch 
indicates that enactment of the bill would have no fiscal effect 
on its operations. The Kansas Association of Counties 
indicates that enactment of the bill would have no fiscal effect 
on county governments.
