Dear Representative Kessler: 
 
 SUBJECT: Fiscal Note for HB 2196 by Representative Ballard 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning HB 2196 is 
respectfully submitted to your committee. 
 
 HB 2196 would provide a permanent exemption for postsecondary educational institutions 
from the public building requirements under the Personal and Family Protection Act.  The bill 
would take effect upon its publication in the Kansas Register.  
 
 The Board of Regents indicates enactment of the bill could have a fiscal effect on 
postsecondary educational institutions.  Since July 1, 2017, when the exemption expired, each 
postsecondary educational institution has implemented various security measures, including metal 
detectors, and additional security officers to comply with the law’s requirements during large 
events or in specific buildings or areas of campus where firearms are prohibited.  The Board states 
there could be some cost savings; however, the Board is unable to estimate those cost savings.  
 
 The Office of the Attorney General states enactment of the bill could make the state subject 
to a legal challenge under federal constitutional grounds.  The agency estimates additional State 
General Fund expenditures of approximately $1.0 million in both FY 2026 and FY 2027 to hire 
outside counsel for a litigation challenge; however, the agency indicates ligation costs could 
exceed the $1.0 million estimate.  Any fiscal effect associated with HB 2196 is not reflected in 
The FY 2026 Governor’s Budget Report.
