SESSION OF 2025 SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2221 As Amended by House Committee on Corrections and Juvenile Justice Brief* HB 2221, as amended, would create a new fund within the Kansas Department for Aging and Disability Services (KDADS) for alcohol and drug abuse treatment, transfer funds and liabilities to the fund, and abolish a corresponding Kansas Department of Corrections (KDOC) fund. Under current law, a portion of certain fines related to the crime of driving under the influence are paid to the KDOC Fund. The bill would create the Alcohol and Drug Abuse Treatment Fund (Fund) within KDADS and direct that on July 1, 2025, all moneys in the KDOC Alcohol and Drug Abuse Treatment Fund be transferred to the KDADS Fund and all liabilities of the KDOC fund be assumed by the KDADS Fund. The bill would make technical amendments by replacing statutory references to the KDOC Fund with the KDADS Fund to carry out the provisions of the bill. The supplemental note and fiscal note for this bill may be accessed on the Internet at https://klrd.gov/ House Committee on Corrections and Juvenile Justice In the House Committee hearing, proponent testimony was provided by representatives of KDADS and KDOC who indicated the KDOC Fund was originally created when some KDOC offenders were participants in a program for persons who had been convicted of a third DUI offense. Now offenders under KDOC supervision are no longer part of the program, so moving the Fund to KDADS would streamline the funding of related programs. No other testimony was provided. The House Committee adopted a technical amendment to the bill to correct a word in the title and update a reference to a renumbered paragraph. Fiscal Information According to the fiscal note prepared by the Division of the Budget on the bill, as introduced, KDADS and KDOC indicate enactment of the bill would have a fiscal effect on the agencies. KDOC indicates its revenues and expenditures would decrease. KDADS estimates its revenue and expenditures would increase, with an estimated total of $1.1 million in court fees under the bill. Any fiscal effect associated with the bill is not reflected in The FY 2026 Governor’s Budget Report.
