Dear Representative Humphries: 
 
 SUBJECT: Fiscal Note for HB 2224 by Representatives Simmons and Fairchild 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning HB 2224 is 
respectfully submitted to your committee. 
 
 HB 2224 would expand the requirements for execution of a search warrant.  Currently, a 
search warrant can be executed at any time of day or night.  The bill would require a law 
enforcement officer to be uniformed and knock on the door and announce their presence in a 
manner reasonably expected to be heard by the occupants of the dwelling before entering the 
dwelling and executing the search warrant. The bill would also define dwelling as a building that 
is used or intended for use as a human habitation, home, or residence. 
 
 The Board of Indigents’ Defense Services states that there may be some litigation 
associated with expanding the requirements for executing a search warrant, specifically what 
constitutes a properly uniformed officer or if the officer’s knock and announcement were 
reasonably sufficient under HB 2224.  The agency indicates the associated litigation costs are 
expected to be minimal and would be handled within existing resources. The Office of the 
Attorney General, Kansas Bureau of Investigation, and Office of Judicial Administration indicate 
the bill would not have a fiscal effect on agency operations. Any fiscal effect associated with HB 
2224 is not reflected in The FY 2026 Governor’s Budget Report.  
 
 The Kansas Association of Counties and the League of Kansas Municipalities indicate that 
HB 2224 could have a fiscal effect on the local governments if officers being required to knock 
and announce their presence increases the threat of harm to the officers and the risk that suspects  The Honorable Susan Humphries, Chairperson

would flee.  However, the Association and the League are unable to estimate any fiscal effect if 
the bill is enacted.
