The Honorable William Sutton, Chairperson
House Committee on Insurance

Dear Representative Sutton:

SUBJECT: Fiscal Note for HB 2247 by House Committee on Health and Human
Services

In accordance with KSA 75-3715a, the following fiscal note concerning HB 2247 is
respectfully submitted to your committee.

HB 2247 would require any review, audit, or investigation by a nonprofit dental service
corporation concerning healthcare provider claims that results in the recoupment or setoff of funds
previously paid to the healthcare provider to be completed not more than six months after the
completed claims were initially paid. The bill would specify that certain reviews, audits, or
investigations would not be restricted by the six-month requirement. The bill would prohibit a
dental benefit plan or utilization review entity from denying a claim submitted by a dentist for
procedures outlined in an approved prior authorization, with certain limitations. The bill would
prohibit a contract between an insurer and a dentist from including certain fees, services, or billing
limitations.

The Division of State Employee Health Benefits Program in the Department of
Administration indicates enactment of the bill would not have a fiscal effect on the Department.
However, the Department notes that the services affected by the bill are not covered services under
the State Employee Health Plan and enactment of the bill would only affect the amount that
members pay. Based on 2024 claims data, the Department estimates that enactment of the bill
would subject plan members to an additional $3,332,411 annually for dental services with no
increase in dental benefits. These costs would be paid by plan members and not the Department.
  The Honorable William Sutton, Chairperson

The Department of Insurance and the Dental Board indicate enactment of the bill would
not have a fiscal effect. Any fiscal effect associated with HB 2247 is not reflected in The FY 2026
Governor’s Budget Report.

 	Sincerely,
