Dear Representative Proctor: 
 
 SUBJECT: Fiscal Note for HB 2258 by Representative Ballard 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning HB 2258 is 
respectfully submitted to your committee. 
 
 Under current law, the Secretary of State appoints the election commissioner in counties 
that have a population exceeding 125,000 and the election commissioner administers the Office of 
Commissioner of Elections.  On or after July 1, 2025, under HB 2258, the Secretary of State would 
no longer appoint any person to the Office of County Election Commissioner.  Upon the vacancy 
in the office in any county, all jurisdiction, powers, and duties of the office relating to the conduct 
of elections would be transferred to the county clerk of such county. In addition, all files, books, 
records, papers, documents, and data under the jurisdiction and control of the office would be 
transferred and delivered to the county clerk.  Current law would cease to have force and effect on 
the date that no person holds the office.   
 
 The Secretary of State indicates it would use existing resources to update public materials 
concerning the election process. Any fiscal effect associated with HB 2258 is not reflected in The 
FY 2026 Governor’s Budget Report.  
 
 The Kansas Association of Counties states enactment of HB 2258 could have a fiscal effect 
on counties during the transition from an election commissioner to a county clerk; however, the 
Association is unable to estimate a precise fiscal effect.
