Dear Representative Lewis: 
 
 SUBJECT: Fiscal Note for HB 2312 by House Committee on Corrections and Juvenile 
Justice 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning HB 2312 is 
respectfully submitted to your committee. 
 
 HB 2312 would exclude certain offenders convicted of a nonperson felony from 
participation in certified drug abuse treatment programs.  The bill would also authorize a 
community correctional services officer or a court services officer to complete criminal risk-need 
assessment for the certified drug abuse treatment program for persons who have entered into a 
diversion agreement.  A criminal risk-need assessment is a part of the presentence investigation to 
determine if an offender meets the criteria for participation in a drug abuse treatment program. 
 
 The Kansas Sentencing Commission estimates that enactment of HB 2312 could have an 
effect on prison admissions, bed space, and workload of the Commission; however, any fiscal 
effect would be negligible.  The Department of Corrections indicates any fiscal effect of enactment 
of the bill would be negligible.  The Judicial Branch indicates HB 2312 would not have a fiscal 
effect on agency operations. Any fiscal effect associated with HB 2312 is not reflected in The FY 
2026 Governor’s Budget Report.  
 
 The Kansas Association of Counties indicates that HB 2312 could increase the need for 
more jail beds as individuals await transfer to state facilities if not approved for participation in 
the certified drug abuse treatment program. The League of Kansas Municipalities provides that 
HB 2312 could increase expenditures for municipalities if the municipal courts and law  The Honorable Bob Lewis, Chairperson

enforcement officers need to develop and implement new procedures.  However, the Association 
and the League are unable to estimate a fiscal effect.
