SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2338
As Amended by House Committee on 
Commerce, Labor and Economic Development
Brief*
HB 2338, as amended, would amend law relating to 
issuing temporary cosmetology permits. The bill would allow 
any person to apply to the Kansas State Board of 
Cosmetology (Board) for a temporary location or temporary 
guest artist permit. 
Temporary Location Permit
The Board may grant a temporary location permit if the 
applicant:
●Is not licensed in Kansas;
●Is licensed to practice such a profession regulated 
by the Board in another state or jurisdiction; and
●Such license has not been revoked, suspended, or 
conditioned from the practice of such profession.
Temporary Guest Permit
The Board may grant a temporary guest artist permit to 
an applicant to provide services regulated by the Board at a 
state or national convention, an establishment licensed by the 
Board, or any other event location approved by the Board.

in Kansas, the Board may grant a temporary guest artist 
permit if the applicant is licensed to practice such a 
profession regulated by the Board in another state or 
jurisdiction and such license has not been revoked, 
suspended, or conditioned from the practice of such 
profession.
General Provisions
The bill would not allow the Board to require a Social 
Security number from applicants for either permit if the 
applicant is a citizen of a foreign country, has not been issued 
a Social Security number, and is not licensed by any other 
state. The bill would require the Board to accept a valid visa 
or passport identification number instead.
Any permit issued under this Act would expire no later 
than 14 days after the Board issues the permit.
The bill would allow the Board to adopt rules and 
regulations as necessary to implement the Act.
The bill would also make a technical change to correct a 
drafting error.
Background
The bill was introduced by the House Committee on 
Commerce, Labor and Economic Development at the request 
of Representative Proctor.

Development
In the House Committee hearing, proponent testimony 
was provided by Representative Proctor and a private citizen. 
The proponents generally stated the bill would clarify the 
2- 2338 intent of the original cosmetology legislation that is being 
amended.
Written-only proponent testimony was provided by a 
representative of the Board.
No other testimony was provided.
The House Committee amended the bill to correct a 
drafting error.
Fiscal Information
According to the fiscal note prepared by the Division of 
the Budget on the bill, the Board indicates the bill would not 
have a fiscal effect on agency operations. 
The Kansas Association of Counties and the League of 
Kansas Municipalities state the bill would not have a fiscal 
effect on cities or counties.
