Dear Representative Humphries: 
 
 SUBJECT: Fiscal Note for HB 2353 by House Committee on Judiciary 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning HB 2353 is 
respectfully submitted to your committee. 
 
 HB 2353 would require any physician or healthcare provider who prescribes, dispenses or 
administers any medicine or drug for the purpose of inducing an abortion to provide a written 
notice as specified in the bill.   
 
 According to the Office of the Attorney General, enactment of HB 2353 could result in 
adverse litigation.  The Offices estimates that litigation costs of at least $500,000, all from the 
State General Fund, in FY 2026 and FY 2027 would be needed to defend the law.  The Office of 
Judicial Administration states that enactment of the bill would not have a fiscal effect on the 
expenditures or revenues of the Judicial Branch or the revenues to the State General Fund.  The 
Kansas State Board of Healing Arts states there could be some related actionable complaints 
related to enactment of the bill but those would be handled within existing resources.  The Kansas 
Board of Pharmacy does not anticipate a fiscal effect as a result of enactment of the bill.  Any 
fiscal effect associated with HB 2353 is not reflected in The FY 2026 Governor’s Budget Report.
