SESSION OF 2025 SECOND CONFERENCE COMMITTEE REPORT BRIEF SENATE SUBSTITUTE FOR HOUSE BILL NO. 2 382 As Agreed to March 26, 2025 Brief* Senate Sub. for HB 2382 would require any school district that offers courses or other instruction regarding human growth, human development, or human sexuality to include, as part of the course or instruction, a human fetal development presentation. The bill would also allow the State Board of Education (State Board) to establish the rates of compensation that board members receive for regularly scheduled meetings of the State Board and any other in-state meeting for participation in matters of educational interest to the State of Kansas. Presentation Requirements The bill would require the human fetal development presentation to meet the following requirements: ●Be a high-quality, computer-generated animation or high-definition ultrasound; ●Be at least three minutes in length; and ●Show the development of the brain, heart, and other vital organs in early human fetal development. The bill would further require that such human fetal development presentations be included in any course or instruction regarding human growth, human development, or human sexuality. State Board of Education Member Compensation The bill would allow for the State Board to determine the compensation amounts received by board members for their service at regularly scheduled meetings of the State Board and any other in-state meeting for participation in matters of education interest to the State of Kansas. ____________________ *Conference committee report briefs are prepared by the Legislative Research Department and do not express legislative intent. [Note: HB 2382, as passed by the House, would have established set compensation amounts for board members while attending regularly scheduled board meetings and in-state meetings of education interest to the State of Kansas.] Background SB 275 The Senate Committee on Education recommended a substitute bill that contained the contents of SB 275. The provisions of the bill as passed by the House were removed from the bill. [Note: HB 2382, as further amended by the House Committee on K-12 Education Budget, would have amended provisions regarding compensation for members of the State Board.] SB 275 was introduced by the Senate Committee on Federal and State Affairs at the request of Senator Erickson. Senate Committee on Education In the Senate Committee hearing, proponent testimony was provided by a representative of Kansans for Life and a private citizen. The proponents generally stated that the bill would ensure students are provided with scientifically accurate information about fetal development. Written-only proponent testimony was provided by a representatives of Kansas Catholic Conference and Kansas Family Voice, and by two private citizens. Opponent testimony was provided by representatives of Loud Light Civic Action and Planned Parenthood Great Plains Votes. The opponents generally stated that the bill does not contain any provisions to ensure presentations meet standards for medical or scientific accuracy and could potentially harm the ability of students to make well-informed decisions about their bodies. Written-only opponent testimony was provided by representatives of Game On for Kansas Schools, Kansas Association of School Boards, Kansas National Education Association, Kansas PTA, Mainstream Coalition, the State Board, and Trust Women Foundation, and by 18 private citizens. Written-only neutral testimony was provided by a representative of Olathe Public Schools. No other testimony was provided. 2 - 2382 HB 2382 The bill was introduced by the House Committee on Appropriations at the request of Representative Goetz. House Committee on K-12 Education Budget In the House Committee hearing on February 17, 2025, written-only proponent testimony was provided by representatives of the State Board. During the hearing, representatives of the Kansas State Department of Education (KSDE) clarified the mechanics of how compensation payments would work and addressed questions from the Committee. No other testimony was provided. The House Committee amended the bill to make technical changes on February 18, 2025. On February 25, 2025, the bill was withdrawn from the House Calendar and referred back to the House Committee. On March 3, 2025, the House Committee further amended the bill to: ●Set board member pay to $286.81 per calendar day for regularly scheduled State Board meetings and the first 12 calendar days a board member is attending other official business within the state; ●Set board member pay at $172.00 per calendar day for days 13 or more of other official business a board member is attending within the state; and ●Clarify that a board member would receive either travel expenses or subsistence expenses for out-of-state travel. Senate Committee on Education In the Senate Committee hearing, written-only proponent testimony was provided by representatives of the State Board. No other testimony was provided. The Senate Committee amended the bill to remove the contents of HB 2382, as passed by the House, and insert the contents of SB 275. Fiscal Information SB 275 According to the fiscal note prepared by the Division of the Budget on SB 275, KSDE states that the bill would not have a fiscal effect on state aid to school districts. The Division of the Budget notes that school districts that would be required to provide a human fetal 3 - 2382 development presentation could have additional expenses to acquire the presentation; however, no fiscal effect could be estimated. HB 2382 According to the fiscal note prepared by the Division of the Budget on the bill, as introduced, KSDE estimates that enactment of the bill would require an additional $169,324 from the State General Fund (SGF) for board member salaries and wages for a total cost of $294,966 SGF for FY 2026. The estimate is based on a current daily legislative salary of $286.81 with an average of 78 days worked per fiscal year for members of the State Board. Any fiscal effect associated with enactment of the bill is not reflected in The FY 2026 Governor’s Budget Report. A fiscal note on the bill, as further amended, was not available at the time of Committee action; however, a KSDE representative stated to the Budget Committee that the amendments would decrease the additional SGF required to $120,000.
