SUPPLEMENTAL NOTE ON SENATE BILL NO. 146
As Recommended by Senate Committee on 
Federal and State Affairs
Brief*
SB 146 would direct the Secretary for Aging and 
Disability Services (Secretary), on or before July 1, 2026, to 
execute and record an amendment to the original deed for a 
conveyance located in Miami County, Kansas, from the 
Kansas Department for Aging and Disability Services 
(KDADS) to the City of Osawatomie.
Current law provides that on July 1, 2026, the right, title, 
and interest for any portion of the real estate not used for 
economic development would return to the State. The bill 
would provide for the date on this revisionary interest be 
amended to July 1, 2046.
The bill would also provide for the Secretary to execute 
and record a corrective amendment to the deed if the 
Secretary finds the legal description of the real estate to be 
incorrect. The amendment would be subject to approval by 
the Attorney General.
Background
The bill was introduced by the Senate Committee on 
Federal and State Affairs at the request of the City Manager 
of Osawatomie on behalf of the City of Osawatomie.

In the Senate Committee hearing, proponent testimony 
was provided by the City Manager of Osowatomie, who 
stated the real estate was conveyed to the city for economic 
development purposes in 2006. The City Manager stated the 
bill would provide the city with additional time to secure 
funding, complete planning processes, implement projects, 
and continue efforts to recruit businesses to stimulate 
economic growth, create jobs, generate tax revenue, and 
improve the overall quality of life in Miami County. In his 
testimony, the City Manager provided a timeline of efforts to 
pursue development of the area beginning in 2006.

member of the Miami County Board of County 
Commissioners (Board) on behalf of the Board.

The Senate Committee recommended the bill be placed 
on the Consent Calendar.
Fiscal Information
According to the fiscal note prepared by the Division of 
the Budget on the bill, KDADS indicates enactment of the bill 
would have no fiscal effect on the agency.
