Dear Senator Gossage: 
 
 SUBJECT: Fiscal Note for SB 31 by Senate Committee on Public Health and Welfare 
 
 In accordance with KSA 75-3715a, the following fiscal note concerning SB 31 is 
respectfully submitted to your committee. 
 
 SB 31 would require treating dentists to provide patients with certain basic information as 
specified in the bill about the dentist and the dental practice ownership upon request by a patient.  
If this information was not provided when requested, the dentist would be subject to disciplinary 
action by the Kansas Dental Board.  The bill would remove the current requirement for dentists to 
be personally present in their office operating as a dentist or personally overseeing such operations 
that are performed in the office or each of the offices at least 20.0 percent of the time patients are 
being treated in the office or each of the offices.  In addition, provisions allowing exceptions to 
this requirement would also be removed. 
 
 SB 31 would also allow the Board to take disciplinary action against any applicant or 
licensee if they directed or pressured another dentist who is an employee, associate, or subordinate 
to perform dentistry that failed to adhere to the applicable standard of dental care or that violates 
the Act.  The bill would prohibit dentists and contracts for dental services from requiring a patient 
to sign an agreement that attempts to limit the patient’s ability to file a complaint with the Board. 
 
 The Kansas Dental Board reports that enactment of SB 31 would not have a fiscal effect 
on the agency.
