PURPOSE OF MEASURE: House Bill 123 prohibits any governmental body or political 
subdivision of the Commonwealth from entering into contracts over $100,000 with a company 
that has ten or more employees and discriminates, as defined in the measure, against firearms 
entities or firearm trade associations.  
 
FISCAL EXPLANATION : The practice of non-economic prohibitions on state purchasing or 
contracting, otherwise known as preference programs or policies, can restrict competition and 
result in higher costs to procuring entities. The number of companies that would be prohibited 
from entering into contracts with the Commonwealth under the measure’s criteria is uncertain; 
and thus, the corresponding potential decreases in competition and increases in contract costs to 
the Commonwealth as a result of the prohibition are indeterminable, but likely nominal.
