FISCAL EXPLANATION : The practice of non-economic prohibitions on state purchasing or contracting, otherwise known as preference programs or policies, can restrict competition and result in higher costs to procuring entities. The number of companies that would be prohibited from entering into contracts with the Commonwealth under the measure’s criteria is uncertain; and thus, the corresponding potential decreases in competition and increases in contract costs to the Commonwealth as a result of the prohibition are indeterminable, but likely nominal.
