AN ACT relating to Medicaid coverage for postpartum behavioral healthcare. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 205.592 is amended to read as follows: 3 
(1) [Beginning October 1, 1990, ]Pregnant women and children up to age one (1) shall 4 
be eligible for participation in the Kentucky Medical Assistance Program if: 5 
(a)[(1)] They have family income up to but not exceeding one hundred[ and] 6 
eighty-five percent (185%) of the nonfarm income official poverty guidelines 7 
as promulgated by the Department of Health and Human Services of the 8 
United States as revised annually; and 9 
(b)[(2)] They are otherwise eligible for the program. 10 
(2) For pregnant women deemed eligible for the Kentucky Medical Assistance 11 
Program pursuant to subsection (1) of this section, the Department for Medicaid 12 
Services and any managed care organization with whom the department 13 
contracts for the delivery of Medicaid services shall cover behavioral health 14 
services, including treatment for postpartum depression and substance use 15 
disorders, for twelve (12) months postpartum. 16 
Section 2.   If the Cabinet for Health and Family Services or the Department for 17 
Medicaid Services determines that a waiver or any other authorization from a federal 18 
agency is necessary prior to the implementation of any provision of Section 1 of this Act, 19 
the cabinet or department shall, within 90 days after the effective date of this Act, request 20 
the waiver or authorization and shall only delay full implementation of those provisions 21 
for which a waiver or authorization was deemed necessary until the waiver or 22 
authorization is granted. 23
