AN ACT relating to judicial districts and circuits and declaring an emergency. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 23A.020 is amended to read as follows: 3 
The state is divided into judicial circuits, each to be composed of the following counties: 4 
(1) First Judicial Circuit. Ballard, Carlisle, Fulton, and Hickman. 5 
(2) Second Judicial Circuit. McCracken. 6 
(3) Third Judicial Circuit. Christian. 7 
(4) Fourth Judicial Circuit. Hopkins. 8

The Thirtieth Judicial District is entitled to sixteen (16)[seventeen (17)] District Judges 1 
and shall have sixteen (16)[seventeen (17)] numbered divisions of the District Court. 2 
Section 10.   The terms of the new judgeships created by Sections 2, 4, 5, and 6 3 
of this Act shall begin January 2, 2023, and elections to fill the judgeships shall be placed 4 
on the ballot for the regular election held in November 2022. 5 
Section 11. Notwithstanding KRS 118A.060(2), a candidate for a judgeship 6 
created by Sections 2, 4, 5, and 6 of this Act may file a petition for nomination not later 7 
than the first Tuesday after the first Monday in June preceding the day fixed by law for 8 
holding the regular election in November 2022. The petition shall be filed no later than 4 9 
p.m. local time at the place of filing when filed on the last date on which the papers are 10 
permitted to be filed. The petition for nomination shall be sworn to by the candidate and 11 
by not less than two (2) registered voters from the circuit from which he or she seeks 12 
nomination, before an officer authorized to administer an oath. The petition for 13 
nomination shall further comply with the provisions of KRS 118A.100(4), and the 14 
procedures established under KRS 118A.100(5) to (12) shall apply. All candidates for the 15 
judgeships created by Sections 2, 4, 5, and 6 of this Act who file a valid petition for 16 
nomination shall be placed on the ballot for the regular election held in November 2022. 17 
Section 12.   The General Assembly requests that the additional Circuit Court 18 
judgeships added in the Third, Sixth, Fourteenth, Sixteenth, and Twenty-Seventh Judicial 19 
Circuits be designated by the Supreme Court as family court divisions as provided in the 20 
Amended Order of the Supreme Court dated December 15, 2021, relating to the 21 
Certification of Necessity, and that the certification be delivered to the Secretary of State 22 
prior to June 7, 2022, provisions of KRS 118A.045(2) to the contrary notwithstanding. 23 
Section 13.   (1) The General Assembly requests that the District Court 24 
divisions eliminated in the Fourth, Thirtieth, Thirty-First, Forty-First, and Fifty-First 25 
Judicial Districts, and the District Court division eliminated in the newly constituted 26 
Thirty-Eighth Judicial District be eliminated effective January 1, 2027, except under the 27  UNOFFICIAL COPY  	22 RS BR 4

circumstances described in subsection (2) of this section. 1 
(2) Should any vacancy occur in any judicial district in this section designated for 2 
elimination, the elimination of the division shall become effective immediately upon the 3 
occurrence of the vacancy and, notwithstanding any provision of law to the contrary, the 4 
vacancy shall not be filled by appointment or otherwise. 5 
Section 14. Unless a District Court division has been eliminated by the 6 
occurrence of a vacancy in accordance with Section 13 of this Act, the General Assembly 7 
requests that when the two District Court divisions of the Fourth, Thirty-First, Forty-First, 8 
and Fifty-First Judicial Districts, and the two District Court divisions of the newly 9 
constituted Thirty-Eighth Judicial District, are reduced to one District Court division 10 
under Section 8 of this Act, the division eliminated shall be the division numbered as 11 
"Division Two," and that when the seventeen District Court divisions are reduced to 12 
sixteen District Court divisions in Section 9 of this Act, the division eliminated shall be 13 
the division numbered as "Division Seventeen." The divisions that are eliminated shall 14 
not appear on the ballot for the November 2026 regular election. 15 
Section 15.   Sections 1, 4, 5, and 6 of this Act take effect January 2, 2023. 16 
Section 16.   Sections 7, 8, and 9 of this Act take effect January 1, 2027. 17 
Section 17.   As portions of this Act will impact judicial elections scheduled for 18 
November 2022 and as vacancies may occur, an emergency is declared to exist, and 19 
Sections 11, 12, and subsection (2) of Section 13 of this Act take effect upon its passage 20 
and approval by the Governor or upon its otherwise becoming a law. 21
