KRS 183.8621 is amended to read as follows: 3 (1) The cabinet shall assign an employee to serve as[Upon recommendation of an 4 individual by the secretary, the commission shall appoint an] administrator of the 5 commission. The administrator shall be an employee of the Department of 6 Aviation. 7 (2) In addition to commission administration responsibilities, the administrator[who] 8 shall[ have immediate supervision of the employees of the commission and] 9 perform such duties as are assigned [him]by the Department of Aviation. 10 (3) The administrator shall be an individual familiar with aeronautics and the 11 commission policy, and[. He] shall keep and be custodian of the records and 12 airport zoning maps adopted by the commission[, and shall devote his full time to 13 the duties of his office]. 14 Section 2. KRS 174.020 is amended to read as follows: 15 (1) The Transportation Cabinet shall consist of the following major organizational 16 units: 17 (a) The Office of the Secretary, which shall include, but not be limited to: 18 1. The secretary to be appointed by the Governor under KRS 12.255; and 19 2. The deputy secretary appointed under KRS 12.040; 20 (b) The Department of Highways, headed by a commissioner, appointed by the 21 Governor under KRS 12.040; 22 (c) The Department of Vehicle Regulation, headed by a commissioner, appointed 23 by the Governor under KRS 12.040. The Motor Vehicle Commission 24 established in KRS 190.058 shall be attached to the Department of Vehicle 25 Regulation for administrative purposes; 26 (d) The Department of Rural and Municipal Aid, headed by a commissioner 27 UNOFFICIAL COPY 22 RS BR 2251 Page 2 of 5 XXXX Jacketed appointed by the Governor under KRS 12.040; 1 (e) The Department of Aviation, headed by a commissioner appointed by the 2 Governor under KRS 12.040. The Kentucky Airport Zoning Commission 3 established by KRS 183.861 shall be attached to the Department of Aviation[ 4 for administrative purposes]; 5 (f) The Office of Support Services, headed by an executive director appointed 6 under KRS 12.040; 7 (g) The Office of Transportation Delivery, headed by an executive director 8 appointed under KRS 12.040; 9 (h) The Office of Audits, headed by an executive director appointed under KRS 10 12.040; 11 (i) The Office of Human Resource Management, headed by an executive director 12 appointed under KRS 12.040; 13 (j) The Office of Information Technology, headed by an executive director 14 appointed under KRS 12.040; 15 (k) The Office of Legal Services, headed by an executive director appointed under 16 KRS 12.040; 17 (l) The following offices, which shall be attached to the Office of the Secretary: 18 1. The Office of Public Affairs, headed by an executive director appointed 19 under KRS 12.040; 20 2. The Office of Budget and Fiscal Management, headed by an executive 21 director appointed under KRS 12.040; 22 3. The Office for Civil Rights and Small Business Development, headed by 23 an executive director appointed under KRS 12.040; 24 4. The Office of Inspector General, headed by an executive director 25 appointed under KRS 12.040; and 26 5. The Office of Project Development, headed by an executive director 4 appointed under KRS 12.040, who shall be a registered professional 5 engineer under KRS Chapter 322, and who shall be known as the deputy 6 state highway engineer for project development; 7 2. The Office of Project Delivery and Preservation, headed by an executive 8 director appointed under KRS 12.040, who shall be a registered 9 professional engineer under KRS Chapter 322, and who shall be known 10 as the deputy state highway engineer for project delivery and 11 preservation; 12 3. The Office of Highway Safety, headed by an executive director 13 appointed under KRS 12.040; and 14 4. Highway District Offices One through Twelve, each district office to be 15 headed by an executive director, also known as the chief district 16 engineer, appointed under KRS 12.040, who shall be a registered 17 professional engineer under KRS Chapter 322; and 18 (n) The following offices, which shall be attached to the Department of Rural and 19 Municipal Aid: 20 1. Office of Local Programs, headed by an executive director appointed 21 under KRS 12.040; and 22 2. Office of Rural and Secondary Roads, headed by an executive director 23 appointed under KRS 12.040. 24 (2) The position of director in the Division of Environmental Analysis is a policy-25 making position under KRS 18A.175. 26 Section 3. KRS 183.140 is amended to read as follows: 27 UNOFFICIAL COPY 22 RS BR 2251 Page 4 of 5 XXXX Jacketed (1)[ The Transportation Cabinet is authorized to establish in cooperation with airport 1 boards, established pursuant to KRS 183.132 through 183.138, a pilot 2 demonstration air service project for the purpose of developing air services on a 3 regularly scheduled basis for the movement of passengers, mail and cargo by a 4 commuter air carrier between five (5) or more airport termini in the Commonwealth 5 of Kentucky at least one of which does not receive service from a carrier certificated 6 by the civil aeronautics board, in the public interest of convenience and necessity 7 for air transportation. 8 (2)] The Transportation Cabinet may reimburse any airport board for direct financial aid, 9 or benefits and services in lieu thereof, which the airport board has expended for the 10 development of commuter air carrier services that provide regularly scheduled 11 passenger, mail and cargo service or any combination thereof to the airport terminus 12 operated by the airport board. 13 (2)[(3)] Any airport board established pursuant to KRS 183.132 through 183.138 is 14 authorized to provide direct financial aid, or benefits and services in lieu thereof, to 15 commuter air carriers that provide regularly scheduled passenger, mail, and cargo 16 service or any combination thereof to their community. 17 Section 4. KRS 183.475 is amended to read as follows: 18 All counties in this state located on the boundary line between this state and any other 19 state, or which are contiguous to such counties, as well as all governmental units which 20 are located in such boundary counties, or contiguous counties, are[ hereby] authorized, 21 separately, jointly with each other, or jointly with any other municipality or political 22 subdivision of any[ such] boundary state, to acquire, equip, construct, expand, lease, 23 improve, police and operate airports within this state or either within or without the 24 geographical limits of any county, municipality or political subdivision of any[ such] 25 boundary state; and for those purposes to exercise any other powers or functions and be 26 subject to any provisions provided by KRS Chapter 183 as to aviation, without regard to 27 UNOFFICIAL COPY 22 RS BR 2251 Page 5 of 5 XXXX Jacketed any express or implied limitations[ thereof] to or within this state[, including but not 1 limited to those provided by KRS 183.010 through 183.012, "Definitions," KRS 183.132 2 through 183.138, "Local Air Boards," KRS 183.475 through 183.490, "Acquisition of 3 Airport Facilities," KRS 183.630 through 183.740, "Bonds," KRS 183.762 through 4 183.772, "Airport Development," and any amendments or supplements thereto which may 5 be provided therein subsequent to this amendment]. 6 Section 5. The following KRS sections are repealed: 7 183.032 Adjudicatory powers and proceedings. 8 183.050 Federal licensing and registration requirement for pilots and aircraft. 9 183.070 State licensing and registration requirement. 10 183.203 Applications for assistance -- Airport loan committee, functions. 11 183.207 Eligibility for loan. 12 183.210 Loan terms -- Security. 13 183.213 Regulations. 14 183.490 Condemnation for privately owned airports. 15
