AN ACT relating to natural resources. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘Section 1. KRS 350.156 is amended to read as follows: 3
(1) After restoration of the acquired land, the cabinet may, with the approval of the 4
Governor, transfer jurisdiction of the[such] land, or any portion thereof, to any state 5
agency that can best utilize the[such] land for public purposes. 6
(2) If the retention of the[such] land is determined to be impractical, the cabinet may, 7
with the approval of the Governor, sell the[such] land to political subdivisions of 8
the Commonwealth at the: 9
(a) Cost of acquisition and restoration; or 10
(b) Auction price at a public sale to the highest bidder. 11
(3) The[Such] land shall be sold subject to the condition that no surface coal mining 12
shall be conducted at any point after the restoration of the acquired land[carried 13
on thereon at any time thereafter]. The proceeds of any [such ]sale of lands 14
acquired pursuant to this section shall be credited to a revolving fund within the 15
cabinet. 16
(3) Whenever the cabinet expends funds pursuant to this section in order to satisfy the 17
total purchase price for lands purchased pursuant to KRS 350.570, the cabinet may 18
return to the revolving fund any moneys expended for the[so used upon] resale or 19
[other] transfer of the[such] land. 20
